DECISION & ORDER
The property at this address is a two story, single family detached home with a three car attached
garage. The property is located in a residential neighborhood in an "FS-RL" (Suburban
Residential Low Density) zoning district. The homeowner operates her photography studio
business out of a commercial location, but desires to move the business to her home because she
does not utilize the commercial studio location frequently. The applicant is seeking a Special
Home Occupation Permit to allow the operation of a photography studio business at this
location. The home photography studio business is proposed to be open Monday through Friday
from 9:00 a.m. to 5:00 p.m., by appointment only. The activity at this location will consist of a
home photography studio specializing in kids and babies, which will not require any revision to
the home. The proposed use will be conducted in the basement of the home. The applicant
proposes to use 600 square feet of the house out of a total area of 2,918 square feet, or 20%,
which is under the maximum code area of 25% permitted for a special home occupation. No
sign is proposed. The homeowner is the only employee of the business. Visits to the home will
be limited to appointment only, but will not exceed five (5) per day. The driveway allows for
parking of three vehicles side by side. There are no other home occupations at this location.
Staff presented evidence that the criteria for a Special Home Occupation Permit as required in
section 29.1304(3) have been met. The applicant made a correction to the hours of operation and
stated that she would like to operate Tuesday through Sunday from 9:00 a.m. to 5:00 p.m. Staff

generally recommends that home occupations operate only half days on the weekends; however,

due to the nature of the business, staff did not feel the impact would be significant and stated that
the criteria have still been met.
DECISION
The Board considers the standards applicable to Special Home Occupation Permits under the
provisions of the zoning ordinance. Having heard the evidence presented about this proposed
business, the Board finds that it meets the standards for the area to be used, signage, and number
of employees. Equipment and the traffic and parking associated with outside employees are not
involved in this business, and client and delivery traffic are in compliance with the standards of
the ordinance and should not light
negatively impact the neighborhood. In of the evidence

presented and the findings in the staff report, the Board determines that granting the permit is
appropriate.
WHEREFORE, IT IS ORDERED that the applicant is Granted a Special Home Occupation
Permit, section 29.1304(3) of the Ames Municipal Code, to allow operation of a photography
studio business at the property located at 508 Beedle Drive, in conformance with the following
condition: the hours of operation be limited to Tuesday through Sunday from 9:00 a.m. to
5:00 P.M.

the filing of this decision.
