FACTS
The property at this address is a two story, single family detached home with a three car attached
garage. The property is located in a residential neighborhood and is bordered on all sides by
single family homes. The property is located in an "F-VR" (Village Residential) zoning district.
The applicant is seeking a Special Home Occupation Permit to allow the operation of a daycare
business at this location. The home daycare business is proposed to allow for up to six children
Monday through Friday from 7:30 a.m. to 5:30 p.m. The activity at this location will consist of a
home daycare which will not require any revisions to the home. The proposed use will be
conducted in the basement of the home. The minimum code requirement of 35 square feet
required for each child will be met as 370 square feet of the house will be used, out of a total area
of 2,280 square feet, or 16%. No sign is proposed. One resident of the home will be an
employee. There will be no additional visits to the home other than the drop off and pick up of
the child. The driveway allows for parking of three vehicles side by side. There are no other
home occupations at this location. Staff presented evidence that the criteria for a Special Home
Occupation Permit as required in section 29.1304(3) have been met. The applicant did not
present any evidence to the contrary.
DECISION
The Board considers the standards applicable to Special Home Occupation Permits from the
provisions of the zoning ordinance. Having heard the evidence presented about this proposed
business, the Board finds that it meets the standards for the area to be used, signage, and number
of employees. Equipment and the traffic and parking associated with outside employees are not
involved in this business, and client and delivery traffic should not negatively impact the
neighborhood. In light of the evidence presented and the findings in the staff report, the Board
determines that all the criteria for a Special Home Occupation Permit required by Ames
Municipal Code section 29.1304(3) have been met and the granting of this permit is appropriate.
ORDER
WHEREFORE, IT IS ORDERED that the applicant is Granted a Special Home Occupation
Permit, section 29.1304(3) of the Ames Municipal Code, to allow operation of a daycare
business at the property located at 2604 Kingston Drive, in conformance with the following
condition: The hours of operation are limited to Monday through Friday from 730 a.m. to
6:00 p.m.
Any person desiring to appeal this decision to a court of record may do so within 30 days after
the filing of this decision.
