RESOLUTION NO.21-337
APPROVING THE MASTER PLAN AMENDMENT FOR 5571 HYDE AVENUE
FOR THE CITY OF AMES,IOWA
WHEREAS,Rose Prairie,LLC owns a 170 acre site at the corner of Hyde Avenue and 190" Street; and,
WHEREAS,this site was originally annexed with a Development Agreement in 2010,and the project was
named Rose Prairie;and,
WHEREAS,the developer now intends to rename the project to Hayden's Preserve from Rose Prairie;and,
WHEREAS,the City Council approved a rezoning of this site with a Master Plan in 2016 that allows for
a mix of development of single-family housing and multi-family housing not to exceed 620 units, along with six
acres of commercial land;and,
WHEREAS, the 2016 approval included substantial modifications as an Addendum to the 2010 Pre-
Annexation Development Agreement,and the 2016 Agreement Addendum,along with the Master Plan,approved
an increase in density and mix of uses; and,
WHEREAS, additionally, development of the site was subject to the City's Conservation Subdivision
Ordinance standards to address issues related to storm water runoff and water quality; and,
WHEREAS,on March 9,2021,the developer went before the City Council with several requested changes
to the 2010 Pre-Annexation Agreement and 2016 Addendum; and,
WHEREAS,the developer's request focused on changes to the Master Plan to help lower development costs
and make the project feasible to begin development in 2021; and,
WHEREAS,the requests included an extension for the timing of the payoff of water and sewer connection
fees, reallocation of street assessments for payoff by phase, changes to the design and timing of sanitary sewer
extension to the west, timing of Hyde Avenue shared use path installation, timing of parkland dedication, and
changes to the Master Plan to eliminate an east-west road connection to Hyde Avenue; and,
WHEREAS,City staff requested along with the developer's changes,that the Plan include a new City east-
west greenway trail; and,
WHEREAS, the total units now being proposed in the 2021 Master Plan for consideration by the City
Council remain the same,but the allowed ranges of dwelling types have been modified to reduce the multi-family
allocation and increase the single-family allocations;and,
WHEREAS, a Master Plan is a City of Ames requirement for development in the Village/Suburban
Residential designated areas of the City; and,
WHEREAS, prior to grading of the site or construction of buildings, a subdivision would need to be
approved to provide the required detail needed to verify consistency with City standards related to lot layouts,road
patterns,and utility extensions,and conservation requirements; and,
WHEREAS,the proposed Development Agreement Addendum requires the north section to be installed
within two years of the first final plat for developable lots to a point agreed upon by the City across from the Ada
Hayden Park parking lot(approximately'/2 mile); and,
WHEREAS,in regards to the south leg of the path,if the path is not completed within two years of the first
final plat,then the developer will be required to construct this path leg within 150 days of the Auburn Trail path
along Hyde being completed; and,
WHEREAS, the requirement of installation upon notice from the City will ensure concurrent timing of
installation with the development to the south,and it will provide a trail across a parcel of land that would otherwise
not see the shared use path connection until such a time that the parcels to the south had additional development;
and,
WHEREAS,another significant change from 2016 is the enlargement and relocation of the neighborhood
park to the north end of the development;the 2016 Agreement required approximately five acres to be dedicated
as a neighborhood park located centrally within the project; and,
WHEREAS,the new east/west greenway would be a valuable long-term infrastructure component for the
City and the development of the trail will be a shared cost with the developer as an enhancement exceeding private
trail requirements; and,
WHEREAS,the 2021 Addendum states that the Developer will connect the path to the bridge if the City
installs the bridge prior to path completion;however,if the developer constructs the path before the City installs the
bridge,the developer will be required to pave the path to within 60 feet on both sides at the approved location;and,
WHEREAS,the 2021 Development Agreement Addendum states that the water and sewer connection fees
will be paid in full upon approval of the first Final Plat after June 30,2031; and,
WHEREAS,the Planning and Zoning Commission met on May 5,2021,and approved the request for the
Amendment to the Master Plan.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ames, Iowa, that the
Amendment to the Master Plan for 5571 Hyde Avenue (Hayden's Preserve -formerly known as Rose Prairie) is
hereby approved.
