Ames Municipal Code Section 29.1503(4)(a): 1. General Standards. The Zoning Board of Adjustment shall review each application for the purpose of determining that each proposed use meets the following standards, and in addition, shall find adequate evidence that each use in its proposed location will: (i) Be harmonious with and in accordance with the general principles and proposals of the Land Use Policy Plan (LUPP). (ii) Be designed, constructed, operated and maintained so as to be harmonious and appropriate in appearance with the existing or intended character of the general vicinity and that such a use will not change the essential character of the area in which it is proposed. (iii) Not be hazardous or disturbing to existing or future uses in the same general vicinity. (iv) Be served adequately by essential public facilities and services such as highways, streets, police, and fire protection, drainage structures, refuse disposal, water and sewage facilities, and/or schools. (v) Not create excessive additional requirements at public cost for public facilities or services. (vi) Not involve uses, activities, processes, materials, and equipment or conditions of operation that will be detrimental to any person, property, or general welfare by reason of excessive production of traffic, noise, smoke, fumes, glare, or odors. (vii) Be consistent with the intent and purpose of the Zone in which it is proposed to locate such use. FINDINGS OF FACT & CONCLUSION: After review of this application, staff has made the following findings of facts: General Standards FINDING 1. The Land Use Policy Plan (LUPP) map designates this site as General Industrial, which is consistent with the use of the land, as approved by the Special Use Permit for the original building. 2 FINDING 2. The proposed change is an expansion of a use that was previously approved by the Zoning Board of Adjustment. No change in use is proposed. FINDING 3. The proposed expansion adds 9,400 square feet of floor area to the second story of the existing building to be utilized as classroom and lab space. FINDING 3. No public utility or infrastructure improvements will be needed. FINDING 4. The City Traffic Engineer has determined that South Bell Avenue has the capacity to handle any increase in traffic volume that results from the proposed building addition. FINDING 5. A minimum of 70 parking spaces are required for the proposed building addition. The site plan includes the construction of 95 additional parking spaces on the site. FINDING 6. The proposed use of the site is allowed within the General Industrial zone with a Special Use Permit as noted in the Use Tables of the Ames Municipal Code. CONCLUSION: Based on staff's analysis, staff has determined that the General Standards of the Ames Municipal Code Section 29.1503(4)(a) have been satisfied. ALTERNATIVES: 1 . The Zoning Board of Adjustment can approve the Special Use Permit to allow the expansion of the Des Moines Area Community College Career Academy- Hunziker Center building and parking lot, at 1420 South Bell Avenue, as shown on the site plan updated and submitted on April 3, 2012 by Stott, Barrientos & Associates Architects, based upon the findings and conclusions of staff. 2. The Zoning Board of Adjustment can deny the Special Use Permit to allow the expansion of the Des Moines Area Community College Career Academy- Hunziker Center building and parking lot, at 1420 South Bell Avenue if the Board determines that the site plan does not comply with the criteria of Section 29.1503(4). 3. Action on this request can be postponed and referred back to City staff and/or the applicant for additional information.
