HomeMy WebLinkAbout~Master - Amendment to the Memorandum of Understanding between the Ames Community School District and the City of Ames regarding The Furman Aquatic Center Parking Lot, Sidewalks, and Paths RESOLUTION NO. 21-243 RESOLUTION APPROVING AMENDMENT TO THE MEMORANDUM OF UNDERSTANDING BETWEEN THE AMES COMMUNITY SCHOOL DISTRICT AND THE CITY OF AMES REGARDING THE FURMAN AQUATIC CENTER PARKING LOT, SIDEWALKS,AND PATHS FOR THE CITY OF AMES,IOWA WHEREAS, the Ames Community School District(ACSD) is building a new high school adjacent to the current high school,and to accommodate construction,much of the existing parking is no longer available for use; and, WHEREAS, a new parking lot was installed this past summer, but it does not have the capacity to accommodate all the vehicles for students and staff,and construction staff need a place to park; and, WHEREAS, athletic events, once spectators are allowed in full, may also create a parking shortage at the high school; and, WHEREAS, the Ames School Administration has requested to use the Furman Aquatic Center(FAC)parking lot for students and staff through May 31, 2023; and, WHEREAS, to accommodate this request, City Council approved a Memorandum of Understanding(MOU) at its October 13, 2020, meeting and the ACSD Board approved the MOU at its October 12, 2020, meeting; and, WHEREAS, the Ames Community School District has now requested to place a generator with a light pole along the path from the high school to the Furman Aquatic Center; and, WHEREAS, since the current MOU focuses on the FAC parking lot, staff determined the MOU should be modified so all parties understand the responsibilities associated with the light;and, WHEREAS, the proposed Amendment added the following paragraph to the MOU: 6.1 Lighting: ACSD is authorized to place a generator with a light pole ("lighting equipment")at the"T-intersection"of the path that leads from the Furman Aquatic Center parking lot to where the path proceeds East of the Ames High School,to illuminate that intersection and the path. ACSD will own the lighting equipment and will be responsible for any maintenance. ACSD may decide at any time to discontinue use of the lighting equipment. The sections below on"Fees," "Insurance," and "Liability, Hold Harmless," and "Indemnification" shall apply to the lighting project.; and, WHEREAS,the Ames Community School District School Board approved the Amendment at its April, 19, 2021, meeting. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ames, Iowa, that the Amendment to the Memorandum of Understanding with the Ames Community School District for use of the Furman Aquatic Center parking lot,sidewalks,and paths,are hereby approved.
