SUBJECT: Follow-up on Special Use Permit for Carney and Sons auto salvage yard at 340 S. Dayton
Avenue.
At the public hearing on January 11, 2012, the Zoning Board of Adjustment tabled action on the
amendment to the Special Use Permit for Carney and Sons auto salvage yard at 340 S. Dayton Avenue.
The Board expressed concern about the fence, its proximity to the south property line, and the impact on
the neighbors.
The Board requested that pictures be provided of the site. The Board also asked staff to talk with the
owners of the residential property to the south about the fence and whether they had concerns. Staff
talked with Lou Kiegley, the property owner of 516 S. Dayton Avenue, on January 27. I made clear to
her that the Board was interested in hearing her perspective and what thoughts she had about the fence. I
explained that the Board wanted to ensure that the fence is compatible. I described several alternatives,
such as landscaping in front of the fence, landscaping behind the fence, or relocating the fence similar to
what was done at the northeast corner of the site. The Board could impose these, or any other action, as
a condition of approval of the amended site plan.
Mrs. Kiegley indicated that Mr. Carney worked with her on removing some of the undergrowth on her
property. She stated that the fence looks good and "we're okay with the fence." She is satisfied with its
installation and with the assurances of Mr. Carney that it would be maintained. She did express concern
with the dust that comes off the site during the removal of the soil and with the smoke from the burning
of the removed vegetation. She spoke with Mr. Carney about the issue and feels that the issue will be
addressed by providing her notification when work will be done so that she can take measures such as
closing her windows.
