RESOLUTION APPROVING ENCROACHMENT PERMIT FOR AWNINGS
AND BUILDING PANELING
AT 330-5TH STREET AND 412 BURNETT AVENUE
FOR THE CITY OF AMES
WHEREAS, Onondago Investments,LLC, is seeking approval for an Encroachment Permit that
would allow three awnings (canopies)that will project 4' -0" out from the face of the exterior brick at:
- 330-5th Street-410" x 9'0" (38SF) canopy above new window in existing masonry
opening
- 412 Burnett-TO" x 10'x 0" (31 SF)north canopy above new storefront main entry in
existing masonry opening
- 412 Burnett-TO" x 12'0" (36SF) south canopy above new window in existing masonry
opening
and allow some exterior building paneling to slightly overhang the sidewalk; and,
WHEREAS, Chapter 22.3(3) of the Ames Municipal Code requires approval of the
Encroachment Permit application by the Ames City Council before the Permit can be issued; and,
WHEREAS,by signing the Agreement,the owner and tenant agree to hold harmless the City of
Ames against any loss or liability as a result of the encroachment,to submit a certificate of liability
insurance that protects the City in case of an accident, and to pay the fee for the Encroachment Permit;
and,
WHEREAS,the applicant/owner also understands that this approval may be revoked at any time
by the City Council; and,
WHEREAS,the fee for this Permit was calculated at$105, and the full amount has been
received by the City Clerk's Office along with the certificate of liability insurance.
NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Ames,Iowa,that
the Encroachment Permit for three awnings(canopies) and some exterior building paneling to slightly
overhang the sidewalk at 330-5th Street and 412 Burnett Avenue is hereby approved.
