HomeMy WebLinkAbout~Master - Development Agreement for the Domani Subdivision, First Addition RESOLUTION NO. 20-571 RESOLUTION APPROVING A DEVELOPMENT AGREEMENT FOR THE DOMANI SUBDIVISION, FIRST ADDITION FOR THE CITY OF AMES,IOWA WHEREAS,the City's subdivision regulations are included in Chapter 23 of the Municipal Code and the Subdivision Code includes the process for creating or modifying property boundaries and specifies whether any improvements are required in conjunction with the platting of property; and, WHEREAS,the creation of new lots is classified as either a major or minor subdivision,with a major subdivision requiring a two-step platting process to finalize the creation of new lots; and, WHEREAS, once the applicant has completed the necessary requirements, including provision of required public improvements or provision of financial security for their completion, a"final plat application"may then be submitted for City Council approval; and, WHEREAS,prior to approval of the Final Plat,there is a condition for the developer to enter into a Development Agreement concerning two issues: 1) subdivision improvements within the City's Christofferson Park and 2)the phasing of the Planned Residence District(PRD); and, WHEREAS, improvements within the City's park include changes to the parking lot and driveway accessing the park due to the extension of Green Hills Drive, grading and revegetation within the south quarter of the park to improve storm water drainage, and the construction of eight- foot walkways in lieu of sidewalks; and, WHEREAS, the developer has provided financial security for the improvements as part of the Letter of Credit for the First Addition, and the developer is subject to indemnity and insurance requirements as well as providing for a two-year warranty on the work completed within the Park; and, WHEREAS,the financial security can be released upon completion of the improvements to the City's satisfaction; WHEREAS, the phasing of the PRD addresses the timing of development in regards to a temporary sales office and a model home, and the Agreement identifies when the proposed clubhouse, temporarily used as a sales office, and swimming pool amenities are required to be completed; and, WHEREAS,the improvements are required prior to starting development of the third phase of the project,and in the event the developer does not complete the amenities and improvements as described, the City may withhold future permits and approvals. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ames, Iowa, that Development Agreement for the Domani Subdivision, First Addition, is hereby approved.
