I, Brian D. Torresi,hereby state that I am an Attorney at Law,duly admitted to the practice
of law in the State of Iowa, and an attorney at Dentons Davis Brown with offices at 120 S. 16th
Street, Ames, Story County, Iowa. I further state that I have examined the Abstract of Title to the
following-described real estate, to-wit:
Outlot WW,Quarry Estates Subdivision Third Addition,Ames,Story County,Iowa
(the "Real Estate") from the root of the title thereof, down to and including the 19th day of May,
2022 at 8:00 a.m., last certified by Abstract and Title Services - Story County, Ames, Iowa(Iowa
Title Guaranty Division Member #8650). The Real Estate has now been subdivided and is now
known as HAYDEN'S RIDGE - TOWNHOME COMMUNITY,AMES, STORY COUNTY,
IOWA.
Based upon information within said Abstract of Title,it is my opinion that the fee simple title
to the Real Estate is vested in 574 Investments, LLC. The Real Estate is subject to easements of
record and to zoning ordinances of the City of Ames, Iowa, as well as the following:
1. Construction Mortgage dated April 15, 2022, in favor of South Story Bank&Trust
and filed in the office of the Recorder of Story County, Iowa, on April 18, 2022, as
Instrument No. 22-03648;
2. Zoning Agreement for Adoption of the Master Plan for Quarry Estates Subdivision
907 W. 190'h Street dated October 14,2014,and filed in the office of the Recorder of
Story County, Iowa, on October 27, 2014, as Instrument No. 14-09612; and
3. Agreement Pertaining to the Annexation of Land to be in the City of Ames (the
"Annexation Agreement"),as said Annexation Agreement is attached to Resolution
No. 13-579 adopted on December 30,2013,and filed in the office of the Recorder of
Story County, Iowa, on August 20, 2015, as Instrument No. 15-08122.
