AGREEMENT FOR PUBLIC IMPROVEMENTS
The parties to this Agreement are Fitch Land Development, LLC, an Iowa member-
managed limited liability company, (the "Owner") and the CITY OF AMES, IOWA (the
WHEREAS, the Owner is in the process of platting real estate to be known as
BIRCH MEADOWS SUBDIVISION, SECOND ADDITION, AMES, STORY
COUNTY, IOWA; and
WHEREAS, the Owner is required to construct certain improvements and utilities
within the real estate, to-wit: street lights, erosion controls, and asphalt roadway surfaces, by
no later than the 30th day of June, 2022, and, to pay reasonable engineering and inspection
fees therefore, all as part of the platting procedure of the City. The estimated cost of the
remaining public improvements is $6. 013.00.
NOW, THEREFORE, in consideration of the premises, it is hereby agreed that the
Owner shall deposit with the City a surety bond, letter of credit or certified check in the
amount of$6 1,013.00 conditioned upon the completion of the improvements and utilities as
required by the City for said subdivision, in accordance with plans and specifications on file
with the City's engineers and by this reference made a part of this agreement. The public
improvements left to be completed are as follows: street paving, erosion control, manhole
adjustments, street trees, and street lighting, and more particularly described on attached
Exhibit A. These public improvements shall be completed no later than June 30, 2022.
IT IS FURTHER AGREED that City reserves the right to construct said

improvements and utilities in the event Owner fails to do so as herein agreed, and to cover
the costs thereof with the surety bond, letter of credit or the certified check, as the case may
be.
IT IS FURTHER AGREED that upon satisfactory completion of the said
improvements and utilities, including the paying of reasonable engineering and inspection
fees therefore, the letter of credit shall be released.
