and Dedication
Know All Persons: The City of Ames,an Iowa municipal corporation is the sole, lawful Owner and
proprietor of the Real Property located in Story County,Iowa,and legally described as follows:
Parcel"A"a part of the Southeast Quarter(SE1/4) of the Northeast Quarter(NE1/4)
of the Northeast Quarter(NE1/4) and a part of the Northeast Quarter(NE1/4) of the
Southeast Quarter(SE1/4) of the Northeast Quarter(NE1/4) all in Section Eight(8),
Township Eighty-three (83) North, Range Twenty-four (24) West of the 51h P.M., in
the City of Ames,Story County,Iowa,as shown on the Plat of Survey recorded on Oc-
tober 1, 1992,in Page 11, Book 59.
The Owner has caused to be filed herewith a subdivision plat of said Real Property together with all
instruments required by law attached hereto and by this reference incorporated as if set out fully,all
in accordance with the requirements of chapters 354 and 355 of the Code of Iowa and the ordinances
of Ames,Iowa,the Owner does hereby consent to the subdivision plat,which shall hereafter be known

Approving final plat of Baker Subdivision,Ames,Iowa
BE IT RESOLVED by the City Council of Ames,Iowa:
1 The City Council has authority, as described in article III, section 38A of the Constitution of the
State of Iowa and in chapters 354 and 355 of the Code of Iowa(2020)and under the ordinances of
the City of Ames,to review and approve subdivision plats of lands lying within the corporate limits
of the city and within two miles thereof.
2 The City Council finds that said subdivision plat together with all of the required attachments and
submissions complies with all requirements of chapters 354 and 355 of the Code of Iowa and the
platting ordinance of the City of Ames.
3 The City Council accepts and approves the subdivision plat to be known as:
BAKER SUBDIVISION,AMES,IOWA,
which is a replat of certain real property more particularly described as:
Parcel"A"a part of the Southeast Quarter(SE 1/4)of the Northeast Quarter(NE 1/4)of the
Northeast Quarter(NE1/4) and a part of the Northeast Quarter(NE1/4) of the Southeast
Quarter (SE1/4) of the Northeast Quarter (NEl/4) all in Section Eight (8), Township
Eighty-three(83)North,Range Twenty-four(24)West of the 51 P.M.,in the City of Ames,
Story County, Iowa,as shown on the Plat of Survey recorded on October 1, 1992, in Page
11, Book 59.
4 The City Council hereby reserves and accepts the lands designated on said plat for easements and
street right-of-way further described as:
Street Lots A(Tripp Street),and B (Latimer Lane),Baker Subdivision,Ames,Iowa.
5 The Mayor and City Clerk are authorized to execute all necessary and appropriate documents cre-
ating said Subdivision.
6 The Clerk is authorized and directed to certify and affix to said plat a true copy of this resolution
in accordance with sections 354.8 and 354.11 of the Code of Iowa.
7 The City Council finds this resolution appropriate and necessary to protect,preserve,and improve
the rights,privileges,property,peace,safety,health,welfare,comfort,and convenience of the City
of Ames and its citizens,all as provided for in and permitted by section 364.1 of the Code of Iowa
(2020).

8 All other resolutions or parts of resolutions in conflict with this resolution are hereby repealed. If
any part of this resolution is adjudged invalid or unconstitutional,such adjudication shall not affect
the validity of the resolution or action of the City Council as a whole or any part thereof not ad-
judged invalid or unconstitutional. This resolution shall be in full force and effect from and after
the date of its approval as provided by law.
APPROVAL OF RESOLUTION:In accordance with Iowa Code section 380.5,the undersigned approves
the foregoing as enacted on May 26 2020,by the City Council.

COVENANT FOR SIDEWALKS AND STREET TREES
WHEREAS, the City of Ames, as Owner, is in the process of platting a subdivision of
real property pursuant to Chapter 23 of the Municipal Code of the City of Ames, Iowa, to be
known as BAKER SUBDIVISION, AMES, IOWA, (the "Subdivision"); and
WHEREAS, the Municipal Code requires the construction of sidewalks and the planting
of street trees as part of the Subdivision platting procedure;
WHEREAS, the City of Ames anticipates transferring Lots within the Subdivision and
intends to create a binding obligation upon subsequent transferees (hereinafter "Owner" which
shall include successors and assigns)to construct Sidewalks as required by the Municipal Code;
NOW THEREFORE, in consideration of the premises, and as part of the approval
process it is hereby understood that:
1. The Owner of each Lot within Baker Subdivision, Ames, Iowa, shall construct a
sidewalk as required by the Municipal Code for said Subdivision, in accordance with
plans and specifications on file with the City's engineers and plant the trees as
required by Section 23.402 of the Municipal Code of the City of Ames, Iowa.
Owners may obtain building and zoning permits for lots within the Subdivision
within 36 months following the approval of the final plat of the Subdivision, with the
understanding that an occupancy permit under City ordinances shall be withheld with
respect to any lot for which the sidewalks have not been installed and the street trees
have not been planted. Further, if the sidewalk is not completed along the lot
frontage of a completed street improvement for the segment of the street abutting the
lot within 36 months of the approval of the final plat of the Subdivision, the Owner
shall install the sidewalk as per City regulations regardless of whether a residence has
been constructed on said lot. No occupancy permit shall be issued after thirty-six
(36) months following approval of the final plat of the Subdivision for a lot unless

said sidewalk has been installed. Required street trees are required prior to issuance
of an occupancy permit.
2. This document shall be filed for record in the office of the Story County Recorder and
all covenants, agreements, promises and representations herein stated shall be deemed
to be covenants running with the land and shall endure and be binding on the parties
hereto, their successors and assigns, for a period of twenty-on (21) years from the
date of the recording of these covenants, unless claims to continue any interest in the
covenants are filed as provided by law.
