SANITARY SEWER EASEMENT
KNOW ALL PERSONS-BY THIS INSTRUMENT that Iowa State University Research
Park("Grantor") does hereby grant the CITY OF AMES, IOWA, the perpetual right to the
following described easements:
A. Sanitary Sewer Easement. Grantor grants to the City of Ames, Iowa, the right to
construct,maintain and use a sanitary sewer located within the real estate described in Exhibit A
(the"Easement Area"), as,part of its sanitary sewer system.
B. General Terms and Conditions. Grantor, its successors and assigns, shall not:
1. erect any structures over or within the Easement Area without obtaining the prior
written approval of the City Engineer.
2. change grade, elevation or contour of any part of the Easement Area without
obtaining prior written approval of the City Engineer.
C. The City of Ames shall have the right of access to the Easement Area granted in this
Sanitary Sewer Easement together with rights of ingress and egress reasonably necessary to the
use and enjoyment of the Easement Area for the purposes described, including, but not limited
to:
1. the rights to remove any unauthorized obstructions or structures placed or erected
on the Easement Area, and
2. the right to improve, repair and maintain the Easement Area.
D. The foregoing rights are granted upon the express condition that users of the granted
rights will assume liability for all damage to the hereinbefore described real estate and adjoining
real estate caused by failure to use due care in the exercise of the granted rights.
E. The terms and conditions of this Sanitary Sewer Easement are binding upon the Grantor,
including, but not limited to, future owners, developers, leasees or occupants. All provisions of
this instrument including benefits and burdens run with the land and are binding upon and inure
to the heirs, assigns, successors, tenants and personal representatives of the parties hereto.

Addition, Ames, Iowa, is subject to this Sanitary Sewer Easement:
Sanitary Sewer Easement:
A strip of varying width across Lot 1, Outlot A and Outlot X, all in Iowa State University
Research Park Phase III, Third Addition, City of Ames, Story County, Iowa, described
as follows: Beginning at a point labeled "A", which is 272.03 feet, S89040'41"Wand
15.61 feet, N49043'45"W of the Northeast Corner of said Lot 1; thence being situated
15.00 feet on each side of the centerline running N89040'41"E, 268.88 feet, and there
terminating; And, Beginning at said point "A"; thence being situated 15.00 feet on each
side of the centerline running S56°16'49"1N, 366.89 feet, and there terminating; And,
Beginning at said point "A"; thence being situated 22.50 feet on each side of the
centerline running N33043'11"W, 198.73 feet; thence being situated 15.00 feet on each
side of the centerline running N65°39'14"W, 84.70 feet; thence N29020'47"W, 888.80
feet to the north line of said Outlot X.
