The following are the corrections needed to the LOC document: (1) The name of the entity is "LDY, LLC" per the records of the Secretary of State and all of the platting documents. (2) Please reference at the top of the LOC to the purpose of the LOC and the relevant subdivision. "LDY SUBDIVISION, FIRST ADDITION [Sidewalk Installation}" Let me know if you have any questions. (2) Have them simply put a reference at the top of the LOC to the purpose of the LOC and the relevant subdivision. "LDY SUBDIVISION, FIRST ADDITION [Sidewalk Installation}" I think this satisfies our need to tie this particular LOC to the project. My preference would be if the sidewalk agreement had included a reference to it, but I consider this change acceptable. Best practice would be if we had a short improvements agreement (here, for sidewalks) in which Developer agrees to an amount and purpose. The actual Sidewalk Agreement is silent on the issue of security. I think an acceptable alternative in this case is if we have the bank indicate on the LOC the purpose of the $27,700 LOC. This is for Developer's protection and for the City's protection. I will mark the LOC and send it out for revision by the bank, in a few minutes. Since we are dealing with a local bank next door to City Hall, I think this would be the most practical solution. I will send out a proposed revision to the LOC in a few minutes. Ames Victoria A.
