-ILOODWAYEASEMENT
KNOW ALL PERSONS:
Amerco Real Estate Company, an Iowa corporation, and B and D Land, L.C. (hereinafter re-
ferred to as the"Grantor"),as owner and proprietor of the following described real property:
U-HAUL SUBDIVISION FIRST ADDITION,AMES,STORY COUNTY,IOWA,
for valuable consideration,does hereby grant to City of Ames,Iowa,(hereinafter referred to as the"Grant-
ee"),a perpetual,non-exclusive easement over and across the following described real property:
Shown on the attached"Exhibit A"(the"Easement Area")
for the purpose of a floodway over,under,and across the Easement Area. The foregoing rights are granted
by the Grantor and shall be accepted and exercised by the Grantee subject to the following terms and condi-
tions:
1. PURPOSES. This floodway easement is granted for the purpose of surface or storm water deten-
tion, flowage,and drainage.Use of the Easement Area shall be limited to vegetative cover. Except
as expressly permitted by the Grantee in writing, no building or other structure shall be erected
within the Easement Area. Grantor,its successors and assigns,shall have no obligation to improve
the Easement Area.
2. NONEXCLUSIVE EASEMENT. The easement rights granted under this instrument to the Grantee are
nonexclusive. This instrument shall not preclude the Grantor from granting similar easement
rights to third parties upon terms and conditions that do not impair or diminish the rights granted
under this instrument to the Grantee.
3. INTERPRETATION. Words and phrases used in this instrument shall be construed as in the single or
plural number, and as masculine,feminine or neuter gender, according to the context.This instru-
ment shall be governed exclusively by and construed in accordance with the laws of the State of
Iowa.The paragraph headings in this instrument are for convenience only and in no way define or
limit the scope or intent of any provisions ofthis instrument.
