Overland Flowage and Storm Sewer Easement. Bella Woods, L.L.C. grants to the Bella Woods Owners' Association, Inc.,perpetual Easements for Overland Flowage and Storm Sewer for the purpose of draining areas and Storm Sewer purposes as, from time to time, determined by the Association over,under,through and across the following described real estate: See Exhibit"A", (P9 3� (hereinafter called "Easement Area") for the purpose of the Association constructing, reconstructing, repairing, grading, improving and maintaining the surface of said Easement Area in a manner that will permit the free and unobstructed flow of surface water over and across the Easement Area for the purpose of draining areas and for the purpose of the Association constructing, reconstructing, repairing, grading, improving and maintaining a storm sewer, together with necessary appurtenances thereto, under, over, through and across said Easement Area. B. Storm Sewer Easement. Bella Woods, L.L.C. grants to the Bella Woods Owners' Association, Inc., a perpetual storm sewer easement for Storm Sewer purposes as, from time to time, determined by the Association over, under,through and across the following described real estate: See Exhibit"B". (hereinafter called "Easement Area") for the purpose of the Association constructing, reconstructing, repairing, grading, improving and maintaining a storm sewer, together with necessary appurtenances thereto,under, over, through and across said Easement Area. C. General Terms and Conditions. Bella Woods, L.L.C., its successors and assigns, shall not: 1 i 1. erect any structures over or within the easement area without obtaining the prior written approval of the Board of Directors of the Association. 2. erect or cause to be placed on the easement area any structure, material device, thing or matter which could possibly obstruct or impede the normal flow of surface water over the easement area without obtaining the prior written approval of the Board of Directors of the Association. 3. change grade, elevation or contour of any part of the easement area without obtaining the prior written approval of the Board of Directors of the Association. D. The Association shall have the right of access to the easement areas granted in this Easement Grant together with rights of ingress and egress reasonably necessary to the use and including,but not limited to: i purposes described nclu area for the , enjoyment of the easement ar purp g 1. the right to remove any unauthorized obstructions or structures placed or erected on the easement area, and 2. the right to improve,repair and maintain the easement area. The foregoing rights are granted upon the express condition that users of the granted rights will assume liability for all damage to the hereinbefore described real estate and adjoining real estate caused by failure to use due care in the exercise of the granted rights.
