WHEREAS, the Declaration of Horizontal Property Regime for Crown Point Condominiums was recorded on December 18, 2003, as Instrument No. 03-25081 of the Story County, Iowa, Recorder's Office (the "Declaration"); WHEREAS, pursuant to Article XVI, Section 1 of the Declaration, the Declaration may be amended by an affirmative vote of sixty-seven percent(67%) of the Owners of the Units; WHEREAS, Declarant is the sole Owner of all of the Units of the Crown Point Condominiums; and WHEREAS, with the Lender's Consent attached hereto, Declarant has the right to amend the Declaration as herein provided. NOW THEREFORE, Declarant hereby amends the Declaration as follows: 1. Definitions. Capitalized terms that are used but not defined or amended in this First Amendment shall have the meanings ascribed thereto in the Declaration. 2. Property Definition. The definition of the Property found in the first"Whereas" clause is hereby amended by deleting: "Lot Two (2), Jewel Park Subdivision Plat 2, Ames, Iowa, And Parcel "A" in the NW 1/4 of the NE 1/4 of Section 23, Township 83 North, Range 24 West of the 5th P.M., in the City of Ames, Story County, Iowa, as shown on the plat of survey filed in the office of the Recorder of Story County, Iowa on the 5th day of May, 1995, and recorded in Certificate and Fill Notes Book 13 at Page 59" FI p,IGQ and replacing it with the following legal description: "Lot Two (2), Jewel Park Subdivision Plat 2, Ames, Iowa, And Lot 1 and Lot 2 Crown Point Subdivision, Ames, Story County, Iowa." From and after the Effective Date the legal description of the real estate upon wem which the Crown Point Condominiums are located shall be Lot Two (2), Jewel Park Subdivision Plat 2, Ames, Iowa, And Lot 1 and Lot 2 Crown Point Subdivision, Ames, Story County, Iowa. 3. Location of Units.Units 1-8,inclusive,203 Jewel Drive are located on Lot 1 Crown Point Subdivision, Ames, Story County, Iowa. Units 1-8, inclusive, 215 Jewel Drive are located #2667336 v.2 on Lot 2 Crown Point Subdivision,Ames, Story County, Iowa. All Exhibits to the Declaration are hereby amended to reflect these changes. 4. Ratification. Except as expressly provided in this First Amendment,all of the terms and provisions of the Declaration are hereby ratified, confirmed and continued in full force and effect.
