I,Franklin J.Feilmeyer,am an attorney licensed to practice in the State of Iowa,and my principal
place of business is located at 323 6th St.. Ames, Iowa 50010. In accordance with section 354.11 of the
Code of Iowa and for the limited purpose described therein, I have examined the abstracts of title to the
Real Property more particularly described in the attached Consent to subdivision platting and to be known
as:
Second Addition,Friedrich's Commercial Addition,Ames,Iowa.
IT IS MY PROFESSIONAL OPINION,based on said examination,that:
1. The fee simple title to said Real Property is vested in:
R Friedrich and Sons,Inc.
who is the sole owner and proprietor entitled and required to consent to the subdivision platting,
subject to easements, rights-of-way. restrictive covenants of record and applicable govemmental
regulations.
2. There are holders of mortgages, liens,or other encumbrances on said Real Property being platted
as follows:
2.1. The real property was mortgaged by R. Friedrich and Sons, Inc., to Ames Community
Bank to secure an original indebtedness of S1,700,000.00. The mortgage was dated
December 30, 2009, filed on December 30,2009, and recorded as Instrument No. 09-
15465.
2.2. The real property was mortgaged by R. Friedrich and Sons, Inc., to Valley Bank to se-
cure an original indebtedness of$600,000.00. The mortgage was dated March 10 and 23,
2009,filed on March 30,2009,and recorded as Instrument No.09-03266.
