AGREEMENT FOR PUBLIC IMPROVEMENTS
The parties to this Agreement are E.A. Hunziker Development, L.L.C., an Iowa
manager-manacied limited liability company, and D & R Furman, L.L.C., an Iowa
member-managed limited liability company, (the "Owners") and the CITY OF AMES,
IOWA(the"City").
WHEREAS, the Owners are in the process of platting real estate to be known as
BROOKVIENV PLACE WEST SUBDIVISION, FOURTH ADDITION, AINIES, STORY
COUNT x',IOWA; and
WHEREAS, the Owners are required to construct certain improvements and utilities
within the real estate, to-wit: street lights, erosion controls, and asphalt roadway surfaces, by no
later than the Lja�ay of /L)116/ , 201 .,"__
_2, and, to pay reasonable engineering and inspection
fees therefore, all as part of the platting procedure of the City. The estimated cost of the
remaining public improvements is $
NOW, THEREFORE, in consideration of the premises, it is hereby agreed that the
Owners shall deposit with the City a surety bond, letter of credit or certified check in the amount
of$1 0 L11, OeO e conditioned upon the completion of the improvements and utilities as
required by the City for said subdivision, in accordance with plans and specifications on file with
the City's engineers and by this reference made a part of this agreement. The public
improvements left to be completed are as follows: street paving, erosion control, pedestrian
ramps, manhole adjustments, and street lighting. These public improvements shall be completed

IT IS FURTHER AGREED that City reserves the right to constrict said improvements
and utilities in the event Owners fail to do so as herein agreed, and to cover the costs thereof with
the surety bond, letter of credit or the certified check,as the case may be.
IT IS FURTHER AGREED that upon satisfactory completion of the said improvements
and utilities, including the paying of reasonable engineering and inspection fees therefore, the
letter of credit shall be released.
