I understand that you wish to request a deferment of the requirement for the installation of public sidewalk required for the proposed subdivision. Where the installation of a sidewalk is deferred by the City Council, an agreement will be executed between the property owner/developer and the City of Ames that will ensure the future installation of the sidewalk. The deferment agreement is to be accompanied by a cash escrow, letter of credit, or other form of acceptable financial security [see Section 23.403(14)(a)(i) of the Municipal Code]. Please submit the following items for consideration of your request for a sidewalk deferment from the Ames City Council: 1. A letter addressed to the Mayor and City Council requesting the granting of a deferment of the installation of sidewalk for the proposed Aubry Subdivision, including an explanation that installation of the sidewalk is premature; 2. A written estimate of the cost of the installation of sidewalk in the public street right-of-way for Top-O-Hollow Road, along the entire frontage of the subdivision, which is shown as 132.42 feet on the proposed Final Plat; and, 3. A check for the total amount of the cost of the materials and installation of the sidewalk written to the City of Ames (Please note that this check will be cashed by the City and held in escrow for the sidewalk improvement.); The City Attorney's Office will prepare the sidewalk deferment agreement for signature by the property owners, prior to consideration of your request by the City Council. A copy of this agreement will be provided to you for your review and signature in advance of the City Council meeting. As we discussed, the sidewalk must be constructed of concrete, be a minimum width of 4 feet, and a minimum thickness of 4 inches, except the portion of the sidewalk that crosses the paved driveway, which must have a minimum thickness of 6 inches.
