RESOLUTION NO. 14-071
RESOLUTION SETTING DATE OF PUBLIC HEARING FOR
VACATION OF SANITARY SEWER EASEMENT IN RINGGENBERG PARK
SUBDIVISION, FOURTH ADDITION
FOR THE CITY OF AMES,IOWA
WHEREAS,with the continued development in Ringgenberg Park Subdivision, a request has
been received to vacate a portion of a sanitary sewer easement that was created as a part of Ringgenberg
Park Subdivision, 1"Addition; and,
WHEREAS, the vacation is necessary in order for the property owner to secure financing for
the new Village Cooperative planned for this area; and,
WHEREAS, the current sanitary sewer alignment is in conflict with the proposed building's
footprint, and financing cannot be secured for the project with the sewer and easement in their current
location; and,
WHEREAS, the developer desires to begin construction as soon as the weather allows this
spring, and the Final Flat related to the site is scheduled to be approved at the February 25, 2014,
Council meeting to establish a new easement; and,
WHEREAS,it is also the developer's intent for the new sanitary sewer to be installed in spring
2014; and,
WHEREAS,the developer has agreed to provide a Letter of Credit prior to February 25,2014,
in the amount equal to the proposed relocation costs to secure the promise to relocate the sewer line that
is in the easement presently; and,
WHEREAS, with the easement specified for sanitary sewer, no additional outreach to other
utilities is necessary, since Public Works is the only utility stakeholder in the easement;
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
AMES, IOWA, THAT:
1. Pursuant to Iowa Code section 364.7, publication of notice regarding the proposed
vacation of an electric facilities easement and establishing a public hearing date
regarding the proposal is required.
2. The public hearing regarding the proposal to consider vacation of the City's interest in
a sanitary sewer easement shall be held on February 25, 2014, at 7:00 p.m.
3. The City Clerk is hereby directed to provide notice of the public hearing as required by
Iowa Code section 362.3.
ADOPTED THIS 11"'day of February, 2014.
