EASEMENT GRANT
KNOW ALL PERSONS 6Y THIS INSTRUMENT that KARIN M. SEVDE and
RANDY SEVDE, do hereby grant the CITY OF AMES, IOWA and to Adjoining Owners,
as shown below, the perpetual right to the following described easements.
A. GENERAL_ Un iTy EASEMENT. Karin M. Sevde and Randy Sevde, grant to the
City of Ames, Iowa, the right to construct, reconstruct, maintain and use its electric lines,
consisting of poles, wires, overhead or underground cables, fixtures, anchors and other
similar equipment, or any part thereof, upon, underground, over or across the following
described real estate, all within Woodbridge Subdivision, Plat 2, Ames, Iowa:

Lot 2 East 10'
South 10', except the West 55' thereof
Karin M. Sevde and Randy Sevde, further grant to the City of Ames, Iowa, the
right to permit other utility companies to construct and, in the same manner, maintain its
utility facilities, jointly or severally upon, underground, over or across the real estate as
described above.

B. SANITARY SEWER EASEMENT. Karin M. Sevde and Randy Sevde, grant to the
Benefitted Owners, the right to construct, reconstruct, and maintain a sanitary sewer
line under the following described real estate, all within Woodbridge Subdivision, Plat 2,
Ames, Iowa:

Lot 1 That part of Lot 1 lying West of a line described as follows:
Beginning at a point on the South line of Lot 1 which is 36.95
feet east of the Southwest Comer thereof; thence
N16018'50"E, 82.59 feet to the West line of said Lot 1, and
there terminating.
The Benefitted Owners are the owners of Lots 1 and 2, Woodbridge Subdivision, Plat 2
and the owners of Parcel A of Lot 2, Woodbridge Subdivision.
C. STORM SEWER EASEMENT. Karin M. Sevde and Randy Sevde, grant to the City of
Ames, Iowa, the right to construct, reconstruct, and maintain a storm water lines under
the following described real estate, all within Woodbridge Subdivision, Plat 2, Ames,
Iowa:

Lot 2 Beginning at a point on the West line of Lot 2 which is
172.16 feet north of the Southwest Corner thereof; thence
N00°14'38"W, 23.59 feet along said line; thence
N57042'59"E, 64.89 feet to the beginning of a curve; thence
northerly and northeasterly, 30.36 feet along said curve
having a radius of 63.22 feet, concave to the east, a central
angle of 27°30'47" and being subtended by a chord which
bears N13°30'45"E, 30.07 feet to a point of reverse
curvature; thence northeasterly 3.27 feet along the arc of
said curve concave to the northwest having a radius of
136.78 feet, a central angle of 1*22'14" and being subtended
by a chord which bears N26035'02"E, 3.27 feet to the
Southwest Corner of Lot 1; thence N89045'22"E, 11.05 feet
along the North line of Lot 2 to a point on a curve concave to
the northwest having a radius of 146.78 feet, a central angle
of 3016'17" and being subtended by a chord which bears
S25038'01"W, 8.38 feet; thence southwesterly, 8.38 feet
along said curve to a point of reverse curvature; thence
southwesterly and southerly 25.56 feet along the arc of said
curve concave to the east having a radius of 53.22 feet, a

central angle of 27°30'47" and being subtended by a chord
which bears S13030'45"W 25.31 feet; thence S00014'38"E,
29.72 feet; thence S8904522"W, 10.00 feet; thence
N00°14'38"W, 6.13 feet; thence S57°42'59"W, 64.89 feet to
the point of beginning.
D. PRIVATE EASEMENTS. Karin M. Sevde and Randy Sevde, grant to the Benefitted
Owners an easement for private access and utilities on the West 55 feet of Lot 2.
The Benefitted Owners are the owners of Lots 1 and 2, Woodbridge Subdivision, Plat 2
and the owners of Parcel A of Lot 2, Woodbridge Subdivision.
E. GENERAL CONDITIONS. All such easements are granted according to the following
terms and conditions.
1. With respect to the easements granted the City of Ames, Karin M. Sevde
and Randy Sevde, its successors and assigns, shall not, without obtaining the prior
written approval of the City Engineer:
a. erect any structures over or within the easement area;
b. erect or cause to be placed on the easement area any structure,
material, device, thing or matter which could possibly obstruct or impede the normal
flow of surface water over the easement area; or
C. change grade, elevation or contour of any part of the easement
area.
2. The City of Ames, its assigns and licensees, shall install and maintain
construct, reconstruct, maintain and use its utility lines within the said easement areas
described above in a safe and prudent manner. It shall also restore the Easement areas
in a good and workmanlike manner, including but not limited to restoration of lawns by
sodding or seeding, and restoration of driveways damaged by the City as nearly as
possible to original condition.
3. With respect to the easements granted the adjoining owners, Karin M.
Sevde and Randy Sevde, its successors and assigns, shall not do any of the acts stated
in 1. a, b, and c above without the prior written approval of the benefitted owners.
F. RIGHTs. The City of Ames and the Benefitted Owners shall have the right of
access to the easement areas granted in this Easement Grant together with rights of
ingress and egress reasonably necessary for the use and enjoyment of the easement
area for the purposes described, including, but not limited to,
1. the right to remove any unauthorized obstructions or structures placed or
erected on the easement area and the right, and

2. the right to improve, repair and maintain the utilities installed underground
in the easement area.
3. the right to enforce through appropriate legal action any of the obligations
assumed by the owners of the lots in the subdivision under this Easement Grant.
G. LIABILITY. The foregoing rights are granted upon the express condition that the
users of the granted rights will assume liability for all damage to the described real
estate and adjoining real estate caused by failure to use due care in the exercise of the
granted rights, and will indemnify and hold the Grantors harmless of any liability by the
use of the easement rights granted.
