RESOLUTION NO. 19-617
RESOLUTION APPROVING VACATION OF PUBLIC WALKWAY EASEMENTS FOR
3802 AND 3806 MARIGOLD DRIVE
FOR THE CITY OF AMES,IOWA
WHEREAS,in order to meet pedestrian access requirements,the Final Plat of South Fork,4'
Addition,included five-foot-wide easements for a mid-block sidewalk south of Marigold Drive at 3802
and 3806 Marigold Drive; however, the connecting 10-foot-wide sidewalk easement that would have
continued to the south was not platted with the corresponding South Fork, 8`b Addition; and,
WHEREAS,an easement was obtained one lot farther to the east of 3719 Coy Street when the
9`b Addition was platted; and,
WHEREAS, in order to better align the sidewalk, the five-foot-wide sidewalk and electric
easements were obtained from 3728 and 3732 Marigold Drive properties; and,
WHEREAS, the previously platted 5'public walkway easements at 3802 and 3806 Marigold
Drive are no longer needed and can be vacated.
WHEREAS, pursuant to Iowa Code Section 364.7, notice was given on November 12, 2019,
and a public hearing is being held regarding the proposal of the City to vacate the easement; and,
WHEREAS,vacation of the easement is in the best interest of the City.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
AMES, IOWA THAT:
1. Pursuant to Iowa Code Section 364.7, publication of notice regarding the proposed
vacation of the public utility easement and establishing a public hearing date regarding the proposal has
been made.
2. The public hearing regarding the disposition of the property is hereby closed.
3. The previously platted 5' public walkway easements of the existing public utility
easement across the following described land is hereby vacated:
Easement at 3806 Marigold Drive: The east 5'of Lot 10 of the 4th Addition of South Fork Subdivision
in the City of Ames, Story County, Iowa.
Easement at 3802 Marigold Drive:The west 5'of Lot 11 of the 4th Addition of South Fork Subdivision
in the City of Ames, Story County, Iowa.
ADOPTED THIS 26'day of November, 2019.
