SUBJECT: 2012/13 WEST LINCOLN WAY INTERSECTION IMPROVEMENTS
(LINCOLN WAY AND DOTSON DRIVE)
BACKGROUND:
Increased traffic flow from the South Fork Subdivision area necessitated left-turn lanes
and a signal at the intersection of Lincoln Way and Dotson Drive to accommodate
heavy-turning movements. Turn lanes on Lincoln Way mitigated left-turning, rear-end,
and right-angle traffic accidents at this intersection. An existing agreement required the
South Fork developer and the City to share equally in the construction cost of these
improvements.
On February 12, 2013, City Council awarded this project to Manatt's, Inc. of Ames in the
amount of $549,699. A balancing change order (savings in the amount of $2,763.13)
was administratively approved by staff. That change order reflected actual quantities
installed in the field. Construction was completed in the amount of $546,935.87. Final
acceptance of this project was delayed over the winter of 2013/14 to ensure proper
vegetative restoration growth in the Spring of 2014. Engineering and contract
administration costs are broken out in the table below.
A Traffic Safety Improvement Grant of $500,000 was awarded by the Iowa Department
of Transportation to be used toward construction of this project. The remaining
$46,935.87 will be split equally between the City and the developer, in accordance with
the development agreement approved by Council on December 18, 2012. The
developer's share has been secured with a Letter of Credit in the amount of $125,000
from Pinnacle Properties Ames, LLC. The City's construction share of $23,467.94, as
well as engineering and construction administration costs of $122,655, bring the City's
total costs to $146,122.94. The City's share was budgeted in the amount of $242,500
from Road Use Tax (RUT) funds. The remaining RUT funds (approximately $96,377)
will be utilized on other projects.

ALTERNATIVES:
1. Accept the 2012/13 West Lincoln Way Intersection Improvements (Lincoln Way
and Dotson Drive) as completed by Manatt's, Inc., of Ames, Iowa, in the amount
of$546,935.87.
2. Direct staff to pursue modifications to the project.
MANAGER'S RECOMMENDED ACTION:
This project has now been completed in accordance with the approved plans and
specifications, and is within the approved budget. The project was completed at a
savings compared to the original cost estimates. The developer's share of the final
construction cost is secured by a Letter of Credit until such time as his payment is
received.
Therefore, it is the recommendation of the City Manager that the City Council adopt
Alternative No. 1, thereby accepting the 2012/13 West Lincoln Way Intersection
Improvements (Lincoln Way and Dotson Drive) as completed by Manatt's, Inc., of
Ames, Iowa, in the amount of$546,935.87.

RESOLUTION ACCEPTING COMPLETION OF
2012/13 WEST LINCOLN WAY INTERSECTION IMPROVEMENTS
(LINCOLN WAY AND DOTSON DRIVE)
FOR THE CITY OF AMES, IOWA
WHEREAS, the Public Works Department has filed a certificate of completion for the
2012/13 West Lincoln Way Intersection Improvements(Lincoln Way and Dotson Drive)for the City
of Ames, Iowa, in accordance with a contract dated February 12, 2013,by and between the City of
Ames, Iowa, and Manatt's, Inc., of Brooklyn, Iowa.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Council of the City of
Ames, Iowa, as follows:
Section 1. The total contract for the 2012/13 West Lincoln Way Intersection
Improvements (Lincoln Way and Dotson Drive) has been fully completed by the
Contractor in accordance with the terms of the contract and is hereby accepted and
approved.
Section 2. The total cost of the contract is $546,935.87.
Section 3. The amount due Manatt's,Inc.,of Brooklyn,Iowa, is hereby ordered paid as
provided by law.
Section 4. All resolutions or orders or parts thereof in conflict herewith are hereby
repealed to the extent of such conflict.
ADOPTED THIS 12" day of August, 2014.

SUBJECT: SUPPLEMENTAL FUNDING AGREEMENT — SOUTH FORK SUBDIVISION
(INTERSECTION IMPROVEMENTS: LINCOLN WAY & DOTSON DRIVE)
BACKGROUND:
On August 14, 2001, City Council approved a Development Agreement for the South Fork
Subdivision with Terra Firma, LP for the installation of various public improvements associated with
the development. One of those improvements identified was the construction of turn lanes and a
traffic signal at the intersection of Lincoln Way and Dotson Drive. The developer is responsible for
50% of the actual construction costs; the City would pay the other 50% plus any
engineering/inspection fees. It was also determined in an updated traffic study dated June 2010 that
the Level of Service (LOS) had dropped below the threshold outlined in the Development Agreement,
which has triggered the need for the improvement.
A portion of South Fork has been sold to Pinnacle Properties Ames, LLC, care of Keith Arneson,
thereby transferring the public improvement costs to Mr. Arneson. Therefore, Staff has drafted a
Supplemental Agreement that solidifies and updates the provisions in the existing agreement.
On February 28, 2012, City Council approved a Traffic Safety Improvement Program (TSIP) Grant
from the Iowa DOT for $500,000. This Supplemental Agreement will take that grant into account by
applying it against the estimated cost for the improvement of $750,000; leaving $250,000 to be paid
from 50% local/private funds and 50% by Mr. Arneson. That equals $125,000 for which Mr. Arneson
would need to provide financial security prior to the award of the project.
ALTERNATIVES:
1. Approve the Supplemental Funding agreement for the South Fork Subdivision with Pinnacle
Properties Ames, LLC.
2. Direct staff to pursue other funding options.
MANAGER'S RECOMMENDED ACTION:
In the last year, Staff has been working with Mr. Arneson to make possible the in-fill development of
the South Fork area, which notably represents additional single-family housing within the Ames
School District. This agreement will help facilitate that in-fill, while at the same time helping to move
forward needed public improvements for this neighborhood and transportation network.
Therefore, it is the recommendation of the City Manager that the City Council accept Alternative No.
1, thereby approving the Supplemental Funding agreement for the South Fork Subdivision with
Pinnacle Properties Ames, LLC.
