ATTORNEY'S OPINION
I,Brian D.Torresi,hereby state that I am an Attorney at Law,duly admitted to the practice of
law in the State of Iowa, and an attorney at the Davis Brown Law Firm with offices at 2605
Northridge Parkway, Suite 101,Ames, Story County,Iowa. I further state that I have examined the
Abstracts of Title to the following-described real estate, to-wit:
Parcels "G" and "H" in the Northwest Quarter (NW'/) of Section
Thirteen(13),Township Eighty-three(83)North,Range Twenty-four
(24)West of the 5t'P.M.,Ames,Story County,Iowa,as shown on the
"Corrected Plat of Survey"filed in the office of the Recorder of Story
County, Iowa, on February 8, 2001, as Instrument No. 01-01457,
Slide 90, Page 4, except the North Ten (10) feet thereof("Parcels
G&W');
AND,
Parcel "E" a part of the Northwest Quarter(NWi/) of the Northeast
Quarter (NE%) and the Northeast Quarter (NE1/) of the Northwest
Quarter(NW'/),all in Section Thirteen(13),Township Eighty-three
(83) North, Range Twenty-four (24) West of the 5t' P.M., Ames,
Story County,Iowa,as shown on the"Patent"filed in the office of the
Recorder of Story County,Iowa,on September 3, 1998,as Instrument
No. 98-12413, except the North Ten(10) feet thereof("Parcel E")
(Parcels G&H and Parcel E are hereinafter collectively referred to as the"Real Estate")from the root
of the title thereof, down to and including the 7`h day of August,2012, last certified by Abstract&
Title Services of Story County, Ames, Iowa(Iowa Title Guaranty Division Member#8650). The
Real Estate has now been subdivided and is now known as DEERY SUBDIVISION, AMES,
STORY COUNTY, IOWA.
Based upon information within said Abstract of Title,it is my opinion that the fee simple title
to Parcels G&H are vested in Pyle Land L.L.C.and that the fee simple title to Parcel E is vested in
Family Realty L.L.C. The Real Estate is free from encumbrances excepting, however, the
following:
1. The Real Estate is subject to easements and restrictions of record and to
zoning ordinances of the City of Ames, Iowa;
2. Parcel E is subject to that certain S.E. 16t' Street Bridge and Street
Improvement Project Covenant for Assessment of Costs and
Improvements dated January 17, 2007, and filed in the office of the
Recorder of Story County, Iowa, on September 11, 2007, as Instrument
No. 07-10821; and
3. Parcel E is subject to that certain Special Assessment Contract and waiver
Southeast Entryway Project Ames,Iowa dated July 14,2009,and filed in
the office of the Recorder of Story County, Iowa, on August 3, 2009, as
Instrument No. 09-09890.
