Planning and RESOLUTION OF THE BOARD OF SUPERVISORS
Zoning RESOLUTION NUMBER 12-26
WHEREAS, there has been submitted to the Board of Supervisors of Story County,
Iowa, an application to subdivide real estate under the ownership of Mark E. and Margaret M.
Gannon, involving the real estate hereinafter described on Attachment A,and
WHEREAS, Mark E. and Margaret M. Gannon are trustee and the legal titleholders of
said platted real estate, and
WHEREAS, a Preliminary Plat has been submitted to the Planning and Zoning
Commission of Story County, Iowa and said Commission has recommended that the Plat be
approved with conditions, and
WHEREAS, said Preliminary Plat was forwarded to the Board of Supervisors of Story
County, Iowa, and said Board approved the Preliminary Plat, and
WHEREAS, it appears that all conditions and requirements prescribed by Chapter 354
and Chapter 355, Code of Iowa, and as prescribed b the Story Count Development Plan and

the Story County Land Development Regulations, of Story County, Iowa, have been complied
with and met with the Board of Supervisor's approval of a waiver to Section 7.40.E Of the Story
County Land Development Regulations for Lot 3, and
WHEREAS, Story County accepts dedication of Drainage Easement and Lot A, as
shown on the Final Plat, but refuses dedication of Public Utility Easements and Access
Easements, as shown on Final Plat,
AND WHEREAS, it is the opinion of the Board of Supervisors of Story County, Iowa, that
it is advisable and in the best interests of Story County, Iowa, and all persons concerned,that
said Final Plat be approved, and accepted.
NOW, THEREFORE, BE IT RESOLVED that the Final Plat of the Matthew's Summit
Subdivision, involving real estate hereinafter described on Attachment A be and the same is
hereby approved, and accepted and all acts and deeds of the said owners and grantors in
the premises are hereby confirmed and approved and the real estate hereinafter described
on Attachment A shall hereinafter be known as the Matthew's Summit Subdivision.
IT IS FURTHER RESOLVED that the Chair of the Board of Supervisors and the County
Auditor are authorized and they are hereby directed to certify a copy of this Resolution to be
affixed to said Final Plat upon its approval by the Board of Supervisors.

LEGAL DESCRIPTION:
A subdivision of Lots 2, 3 and Parcel E of Lot 3, Arnold Acres in the Northeast Quarter of
Section 26 and the Southeast Quarter of Section 23, all in Township 84 North, Range 24 West
of the 5th P.M., Story County, Iowa, and all being more particularly described as follows:
Beginning at the Northeast Corner of said Lot 2; thence S00°02'47"E, 51.61 feet along the East
line of said Lot 2 to the South line of said Section 23; thence S00021'37"E 700.02 feet along the
East line of said Lots 2 and 3 to the Southeast Corner of said Lot 3; thence S89°38'40"W,
449.92 feet to the Southwest Corner of said Lot 3; thence N00021'37"W, 854.74 feet to the
