RESOLUTION NO. 14-130
RESOLUTION SETTING DATE OF PUBLIC HEARING FOR
PROPOSED VACATION OF PEDESTRIAN EASEMENT IN LOT 7,
SUNSET RIDGE SUBDIVISION, 4TH ADDITION
FOR THE CITY OF AMES, IOWA
WHEREAS, as the Sunset Ridge Subdivision residential development continues to build out,
it was discovered that a City of Ames electric transformer was placed within a pedestrian easement;and,
WHEREAS, staff met with the developer on site to review the area, and it was determined the
most cost effective and acceptable solution would be to relocate the existing pedestrian easement; and,
WHEREAS,with the easement being specified as a pedestrian easement,no additional outreach
to utility companies or entities will be necessary, since the Public Works Department is the only
stakeholder in the easement; and,
WHEREAS, staff sees no issues with relocation of the easement and the future sidewalk; and,
WHEREAS,pursuant to Iowa Code section 364.7,it is necessary to provide notice and a public
hearing regarding the proposal of the City to dispose of its interest in this real property; and,
WHEREAS, following notice and public hearing, the City will determine if this proposal is
appropriate.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
AMES, IOWA, THAT:
1. Pursuant to Iowa Code section 364.7, publication of notice regarding the proposed
vacation of a public pedestrian easement and establishing a public hearing date regarding
the proposal is required.
2. The public hearing regarding the proposal to consider vacation of the City's interest in
a pedestrian easement in Lot 7, Sunset Ridge Subdivision,4"Addition, shall be held on
April 8, 2014, at 7:00 p.m.

3. The City Clerk is hereby directed to provide notice of the public hearing as required by
Iowa Code section 362.3.
ADOPTED THIS 251'day of March, 2014.
