The firm is in process of construction for single- family attached town homes located at 2833, 2839, 2905, and 2907 Roxboro Drive. During the DRC plat review, construction of a dead end fire apparatus access road was required. As a result of the Building Board of Appeals decision,the City has agreed to enter into an agreement that provides temporary non-compliance with this code requirement. The temporary non-compliance period will be acceptable until l l/l/2009. Developer understands and agrees that, in the event that Roxboro Drive is not connected to Stange Road by this date, that developer must then install a code-compliant turnaround as specified in IFC Section 503.2.5, Table D103.4, and D102.1; such turnaround to be constructed and completed by not later than this date. In surety thereof, developer will furnish herewith a$15,000 security in a form acceptable to the City and acknowledges the City's authority to utilize said security upon developer's failure to comply with this agreement. Upon developer's compliance with this agreement;based on City inspection of the development, security is to be released in its entirety to developer. In consideration for this agreement, developer waives right to further additional administrative or legal appeals after the stated performance date. Mr. Winkleblack has agreed to deliver the security agreement to the City Clerk's office prior to initiating any construction related to the homes at 2833, 2839,2905, and 2907 Roxboro Drive.
