I, Victoria A. Feilmeyer, am an attorney licensed to practice in the State of Iowa, and my principal
place of business is located at 1416 Buckeye Avenue, Ste. 200, Ames, Iowa 50010. In accordance with
section 354.11 of the Code of Iowa and for the limited purpose described therein, I have examined the ab-
stract of title from the root of the title thereof,down to and including the 2"d day of October 2009, last certi-
fied by Abstract and Title Services of Story County (Iowa Title Guaranty Division Member N° 8650), to
the Real Property more particularly described in the attached Consent to subdivision platting and to be
known as:
RINGGENBERG PARK SUBDIVISION SECOND ADDITION, AMES, STORY
COUNTY, IOWA.
IT IS MY PROFESSIONAL OPINION, based on said examination,that:
1. The fee simple title to said Real Property is vested in:
RINGGENBERG ESTATES, L.L.C.
which is the sole owner and proprietor entitled and required to consent to the subdivision platting,
subject to easements, rights-of-way, restrictive covenants of record and applicable governmental
regulations.
2. There are holders of mortgages, liens, or other encumbrances on said Real Property being platted
as follows: The real estate was mortgaged by Ringgenberg Estates, L.L.C.,to First National Bank,
Ames, Iowa,to secure an original indebtedness of$3,923,000.00. The mortgage is dated February
7, 2006, and was filed in the office of the Recorder of Story County, Iowa, on March 9,2006, and
recorded as Instrument N°06-02706.
3. The real estate is subject to an Agreement for Sidewalk, Bike Paths and Street Trees entered into
between Ringgenberg Estates, L.L.C., and Friedrich Land Development Company, L.L.C., and the
City of Ames, Iowa. The Agreement is dated December 7, 2005, and was filed in the office of the
Recorder of Story County, Iowa, on January 24,2006,and recorded as Instrument N°06-00942.
4. The real estate is subject to a Development Agreement entered into between Ringgenberg Estates,
L.L.C., and Friedrich Land Development Company, L.L.C., and Ringgenberg Park Property Own-
ers' Association and the City of Ames, Iowa. The Agreement is dated December 20, 2005, and
was filed in the office of the Recorder of Story County, Iowa, on December 5,2006, and recorded
as Instrument N°06-14664.
