HomeMy WebLinkAboutA027 - Council Action Form dated September 12, 2006 ITEM # of DATE 09/12/06 COUNCIL ACTION FORM SUBJECT: PRELIMINARY PLAT FOR GRAND ASPEN SUBDIVISION, 3RD ADDITION BACKGROUND: Property Owner/ Developer: Randall Corporation 420 South 17th Street Ames, Iowa 50010 Contact Person: Scott Renaud Fox Engineering Associates, Inc. 1601 Golden Aspen, Suite 103 Ames, Iowa 50010 Purpose: The Developer is requesting approval of a Preliminary Plat for the subdivision of Outlot `A', Grand Aspen P Addition, into one proposed lot (Lot 1) and one outlot (Outlot 'D'). Location: The subject site is north of South 16th Avenue and directly north and east of the Ames Christian School. The proposed Outlot D is addressed at 715 South 16tr' Street and the proposed Lot 1 is addressed at 915 South 16th Street. Area: 17.68 acres Zoning: RH, Residential High Density LUPP Designation: High-Density Residential Existing Conditions: Land in Outlot A is currently undeveloped with a pond in the southwest corner of proposed Outlot D. Land to the north of the subject site is used as a golf course. To the east of the proposed subdivision is the Aspen Ridge subdivision, a 62-lot single family attached development. South, across South 16th Street, is an office park, multifamily residential uses, and vacant agricultural land. To the west of the proposed subdivision is the Ames Christian School and vacant land owned by the City of Ames. ANALYSIS: Descri tion of surrounding area: Area LUPP Designation Zoning Land Uses North High-Density Residential RH — Residential High Density Golf Course & Environmentally Sensitive Areas South High-Density& Low- RLP — Residential Low Density Creekside Manufactured Density Residential Park & RH — Residential High Home Park &Vacant Land Density East Medium-Density F-PRD — Planned Residence Aspen Ridge Subdivision — Residential & Highway- District Future Single Family Oriented Commercial Attached Residential West High-Density Residential RH — Residential High Density Ames Christian School & Greenway & S-GA — Government/Airport District Development Agreement. A Development Agreement, recorded January 2, 2004, was executed in conjunction with Grand Aspen Subdivision 2"d Addition to ensure that the necessary public improvements were installed in a timely manner. As the Grand Aspen subdivision has further developed, it has been found that a number of items in the existing Developer's Agreement, regarding the timing of the improvements and allowing an access from Lot 1 onto South 16th Street, would need to be revised. Staff has added a stipulation that prior to submittal of subdivision improvement plans and approval of the Final Plat, the Developer's Agreement must be revised to the satisfaction of the City. If the Developer's Agreement is not successfully revised to reflect the approved Preliminary Plat, the applicant shall be required to apply for a revised Preliminary Plat that does reflect the existing Developer's Agreement. Utilities. The utilities adjacent to this site will be adequate to serve the needs of this future development. Water. The City maintains sufficient water capacity to serve this area. A 12-inch water main is located in the South 16th Street right-of-way along the southern side of the subject site. Sanitary Sewer. An existing 10-inch sanitary sewer is located within the South 161" Street right-of-way, directly south of the subject property. Storm Water Management. The applicant has submitted information regarding the storm water management plan, which identifies that the site has been filled above the 100-year flood elevation and currently drains to the north, to the Coldwater Creek Golf Course, and to the east, into the existing detention pond. The detention pond drains by infiltration. However, during severe events,the overflow drains north to the Coldwater Creek Golf Course via an open channel. This overflow drainage is directed to a pond on the golf course which is a zero discharge pond utilized to irrigate the golf course. 2 Electric. The subject area falls within the City of Ames Electric Service Boundary. The site can be adequately and efficiently served by municipal electric services. Streets,Vehicular, and Pedestrian Access. The developer proposes to construct an eight-foot wide bike path along the South 16th Street frontage of Lot 1. The developer is also proposing to widen South 16th Street an additional 12 feet along the frontage of Lot 1. A 30-foot wide drive access to Lot 1 is proposed, aligned with Fountain View Drive. Staff suggests a stipulation to require that a note be added to the Final Plat that restricts any further access onto South 16th Street from the site, assuming that the Developer's Agreement is successfully revised. Essential Community Services. The estimated fire response time to the subject area is well within five (5) minutes. The City's fire response time goal is to have 85% of the land area of the city within a response time of five (5) minutes or less. Fire Station No. 3 on South Duff Avenue would provide fire coverage for this site. Mary Greeley will supply ambulance services to the subject property. The subject area falls within an existing police patrol area. STIPULATIONS: The Preliminary Plat for Grand Aspen 3rd Addition Subdivision can be approved subject to the following stipulations: 1. That the developer will construct and dedicate all public improvements to City of Ames Urban Standards, as required, including: dedication of public right-of-way, street paving, curb, gutter, sidewalks, street lights,water main, sanitary sewer main, and storm sewer improvements, prior to approval of the Final Plat, or execute an Improvement Agreement to guarantee the completion of all public improvements and provide security in the form of an Improvement Guarantee, as set forth in Section 23.409 of the Municipal Code. 2. That prior to submittal of subdivision improvement plans and approval of the Final Plat, the Developer's Agreement must be revised to the satisfaction of the City. If the Developer's Agreement is not successfully revised to reflect the approved Preliminary Plat, the applicant shall be required to apply for a revised Preliminary Plat that does reflect the existing Developer's Agreement. 3. That a note be added to the Final Plat for Grand Aspen, 3rd Addition to restrict any further access from the subject property except as shown on the Preliminary Plat. Recommendation of the Planning &Zoning Commission.At its meeting of September 6, 2006, with a vote of 7-0, the Planning and Zoning Commission recommended approval of the Preliminary Plat with the stipulations listed above. 3 ALTERNATIVES: 1. The City Council can approve the Preliminary Plat for Grand Aspen Subdivision, 3Id Addition with the stipulations listed above. 2. The City Council can deny the Preliminary Plat for Grand Aspen Subdivision, 3Id Addition. 3. The City Council can approve the Preliminary Plat for Grand Aspen Subdivision, P Addition with modifications. 4. The City Council can postpone action on this request and refer it back to City staff and/or the applicant for additional information. MANAGER'S RECOMMENDED ACTION: It is the recommendation of the City Managerthat Alternative#1 be adopted. The proposed Preliminary Plat is consistent with the surrounding land uses, existing zoning, and LUPP designation. Staff supports the three stipulations outlined in this Action Form. Stipulation#1 ensures the installation of the required public improvements. Stipulation #2 requires the successful modification of the existing Developer's Agreement, which would reflect the submitted Preliminary Plat.
