RE: Request for Waiver from Major Plat Requirements for Southern Hills West Replat
Honorable Mayor&City Council:
In accordance with Ames City Code Section 23.103 we are requesting a waiver of the Regulations to
allow the use of the Minor Plat process in lieu of the Major Plat process. A Minor Plat is used when
there are 3 or fewer lots being platted. Anything greater than 3 lots requires the Major Plat which then
requires a Preliminary Plat and Final Plat with Planning&Zoning review before Council action. In our
situation we have 4 lots that are a replat of 5 existing lots. We are combining,consolidating and
cleaning up lot lines to allow for the sale of property to Ag Leader for the construction of their training
facility. No public utilities or streets are required. In cleaning up the lot lines we trimmed a small
triangular parcel off of one lot which adds one lot to the 3 lots being redrawn. This small change has
triggered the Staff to request a Major Plat in lieu of the Minor Plat. Our three choices are to either
remove the parcel to create 3 lots and proceed with the Minor Plat,or go through the Major Plat
process, or seek a waiver. We respectively request the waiver to allow the use of the Minor Plat
process.
Time is of the essence as we would like to finish the lot sale before the end of 2008. Ag Leader has
submitted a site plan for the training facility and will be proceeding with construction as soon as the lot
sale is completed. Our sincere desire is for Council to waive the Major Plat requirements and allow the
use of the Minor Plat at it November 18th Council workshop. We could then continue the Minor Plat
process and be at Council on either November 25th or December 91h. We have been working with Ag
Leader since early this year on this project and started the City process in July of this year.
