I, Craig R. Hastings, hereby state that I am an Attorney at Law, duly
admitted to the practice of law in the State of Iowa, and a member of the firm of
Hastings & Gartin, LLP, with offices at 409 Duff, Ames, Iowa 50010. 1 further
state that I have examined the Abstracts of Title to the following described real
estate, located in Story County, Iowa:
Lots 1, 2, 3, and 4, Southern Hills West, Ames, Iowa
from the date of the root of title thereof, down to and including February 3, 2009
at 8:00 A.M., which abstracts were last certified by Abstract & Title Services of
Story County. The real estate has been re-subdivided and is now to be known as
SOUTHERN HILLS WEST PLAT 2, AMES, IOWA.
Based upon information in the Abstract of Title, it is my opinion that the fee
simple title to said real estate is in MARGUERITE SEVDE, MARGUERITE
SEVDE, AS TRUSTEE OF THE RICHARD H. SEVDE TRUST, KARIN SEVDE,
RANDY SEVDE (as to Lots 1, 2, and 4) and AG LEADER INDUSTRIAL
PROPERTIES, LLC (as to Lot 3) and that said real estate is free from all
encumbrances excepting, however, the mortgage given to Ames Community
Bank, Ames, Iowa on November 11, 2008 and recorded November 12, 2008 as
Inst. No. 08-12093 of the county records that encumbers Lots 1 and 2.
It is my opinion that the real estate is further subject to easements and
restrictions of record and the Zoning and Land Use Ordinances of Ames, Iowa.
