Torresi, hereby state that I am an Attorney at Law, duly admitted to the practice of law in the State of Iowa, and a member of the firm of Nyemaster, Goode, West,Hartsell &O'Brien,P.C.,with offices at 1416 Buckeye Ave.,Ste.200,Ames,Story County,Iowa. I further state that I have examined the Abstract of Title to the following-described real estate,to-wit: Parcel"H",Part of the Southwest Quarter of the Southeast Quarter(SWl/4-SEl/4)of Section Five(5),Township Eighty-three(83)North,Range Twenty-four(24)West of the 5th P.M.,City of Ames, Story County,Iowa,as shown on the Plat of Survey filed in the office of the Recorder of Story County,Iowa, on June 18, 2008,and recorded as Instrument No. 08-06769, and Slide No. 333, Page 3, from the root of the title thereof, down to and including the 15th day of September, 2008, last certified by Republic Abstract of Story County, Nevada, Iowa (Iowa Title Guaranty Division Member #8212).. The Real Estate has now been subdivided and is now known as WALNUT RIDGE SUBDIVISION FIRST ADDITION,AMES, STORY COUNTY,IOWA. Based upon information within said Abstract of Title, it is my opinion that the fee simple title to the real estate is in C & B Lincoln Way, L.L.C. The real estate is subject to a Mortgage in favor of First National Bank, Ames, Iowa, dated September 2, 2008, and filed in the office of the Recorder of Story County,Iowa,on September 15,2008,as Instrument No. 08-10383, in the amount of$750,000.00. The Real Estate is further subject to easements and restrictions of record and to zoning ordinances of the City of Ames, Story County, Iowa. Dated this 26th day of September, 2008.
