I,Brian D.Torresi,hereby state that I am an Attorney at Law,duly admitted to the practice of
law in the State of Iowa,and a member of the firm of Nyemaster,Goode,West,Hansell&O'Brien,
with offices at 1416 Buckeye Ave., Ste. 200, Ames, Story County, Iowa. I further state that I have
examined the Abstract of Title to the following-described real estate, to-wit:
Lots One(1)and Two(2),H&B Subdivision to Ames,Iowa;and the South 140 feet
of the West 122.5 feet of the East 222.5 feet of that portion of the Southeast Quarter
of the Southwest Quarter(SE'/4-SW'/a),lying South of the C&NW Railroad Right-
of-way, except the North 800 feet thereof and except the South 63 feet thereof; and
Parcel"E"in the Southwest Quarter of the Southeast Quarter(SW'/4-SE'/4)as shown
on the Plat of Survey filed in the office of the Recorder of Story County, Iowa, on
October 15,2001 and recorded as Instrument No. 01-14023 on Slide 110 at Page 2;
all in Section One (1), Township Eighty-three (83)North, Range Twenty-four(24)
West of the 5t"P.M., in the City of Ames, Story County, Iowa,
from the root of the title thereof,down to and including the 'j D day of �� ,2008,
last certified by Abstract&Title Services of Story County(Iowa Title Guaranty Division Member
#8650). The real estate has now been subdivided and is now known as SECOND ADDITION,H&
B SUBDIVISION TO AMES, IOWA.
Based upon information within said Abstract of Title, it is my opinion that the fee
simple title to said real estate is in H & B Properties, L.L.C. The real estate is free from
encumbrances,but is subject to easements and restrictions of record and to zoning ordinances of the
City of Ames, Iowa.
