To the City of Ames,
Perfect Games, Inc. (Perfect Games) owns the property locally known as
1320 Dickinson Ave., Ames, IA 50014, and legally described as Lot 1, Dauntless
Subdivision,Ames, Story County, Iowa.
8TH ADDITION,
The City of Ames is the owner of a storm water detention easement
(easement area) recorded April 24, 2001, as Instrument Number 01-04737 of the
county records. Perfect Games intends to improve the easement area by developing
a mini golf course.
Perfect Games is aware that from time to time, the City of Ames may need to
access the adjacent lots beyond the easement area in order to maintain the
easement area. Perfect Games is also aware that any improvements, accessories, or
equipment that are placed in the easement area may obstruct clear passage through
the easement area. Therefore, Perfect Games, and it's successors, agrees to hold the
City of Ames harmless for any damage that the City of Ames, or their agents, causes
to the mini golf improvements, accessories, or equipment as a result of any need to
access the easement area. Additionally, Perfect Games and it's successors will hold
the City of Ames harmless for any damages to any items placed within the easement
area due to flooding that could occur within the area.
Provided, the City of Ames must give Perfect Games written notice 30 days
prior to any intended or planned maintenance that requires the use of, and access
to,the easement area. This notice is intended to allow Perfect Games an opportunity
to clear any improvements or equipment from the easement area.
