RESOLUTION ACCEPTING COMPLETION OF
PUBLIC UTILITIES IMPROVEMENTS REQUIRED FOR
NORTH GRAND MALL
FOR THE CITY OF AMES, IOWA
BE IT RESOLVED, by the City Council of the City of Ames, Iowa:
Section One. In accordance with the Certificate of the Public Works Director, the public
utilities improvements required for the North Grand Mall are hereby accepted as complete and
satisfactory; and,
Section Two. The bond given to secure performance of the public improvements is hereby
released and shall be returned to the subdivider.
ADOPTED THIS 25"day of September, 2012.

I hereby certify that the public utilities as a condition for approval of the final plat for
North Grand Mall have been completed in an acceptable manner by Ames Trenching,
Inc of Ames, IA. The above mentioned improvements have been inspected by the
Engineering Division of the Public Works Department of the City of Ames, Iowa and
found to meet City specifications and standards.
As a result of this certification, it is recommended that the financial security for public
improvements on file with the City be released in full.

The$76,450 bond was required to guaranty installation of the public improvements required to satisfy the
subdivision standards since those improvement were not installed prior to final plat approval. The public
improvement plan, including the itemized list of public improvements (sanitary sewer, water mains, and
hydrants) to be installed, is attached to the bond. See page 5, below:
The public improvement guaranty is the subject of the first sentence of Part IV, Security, in the 2007
development agreement. That same sentence also refers to "an improvement agreement to guarantee
the completion of all such required improvement." That separate agreement is approved by the public
!A),works director and is recorded with the plat documents at page 54. See attached:
If the sanitary sewer, water mains, and hydrants are still needed at NGM to satisfy the subdivision
- � requirements of the Code, the developer should install them before the bond is released. If they are not
j needed, I suppose a new plat would need to be prepared and approved by Council that doesn't reflect the
public improvements, at which time the bond could be released.
I have a meeting away from the office at 2:00 PM Monday, and it's likely I will not be back before the
meeting that is set for 3:30. If you need any more information from me, or if there is action needed as a
result of the meeting, let me know.

In response to your inquiry, please be advised that the City has no pending/deferred/suspended or
dormant special assessments affecting 2501 Grand Avenue. There are no outstanding balances for false
alarms, snow, water meters, or mowing.
In checking for delinquent utility accounts, 2501 Grand Avenue is in the name of Grand Center Partners,
LLC. The account is current with $291.60 in charges due by February 15, 2012.
Please be advised that the City has a Developers'Agreement with North Grand Partners. Security
guaranteeing private improvements in the amount of$478,638 and public improvements in the amount of
$76,450 has been filed in the form of Performance Bonds, which are being held by the City.
