Vande Kamvr County Recorder DO NOT WRITE IN THE SPACE ABOVE THIS LINE,RESERVED FOR RECORDER Prepared by:Judy K.Parks,Ames Acting City Attorney,515 Clark Avenue,Ames,IA 50010 Phone:515-239-5146 Return to:Ames City Clerk,P.O.Box 811 Ames IA 50010 Phone:515-239-5105 RESOLUTION NO. 13-036 RESOLUTION APPROVING VACATION OF UTILITY EASEMENTS IN THE STREETS OF NORTH GRAND SUBDIVISION FOR THE CITY OF AMES,IOWA WHEREAS,the City of Ames has public utility easements on property located at North Grand Mall; and, WHEREAS, the North Grand Mall owners are currently moving forward with improvements identified by a plan approved by the City Council in January 2012,and this plan differs from the original plan approved by Council in 2007; and, WHEREAS,in December 2012,the Council approved a new plat to create a separate lot for the proposed Kohl's building; and, WHEREAS, in order to clear title issues prior to closing, GK Development, the owner of the Mall, is requesting the vacation of these unneeded easements; and, WHEREAS,the City has determined that easements created in a plat approved by the Council in 2007 are no longer needed and should be vacated; and, WHEREAS,pursuant to Iowa Code Section 364.7,notice was given on January 15,2013,and a public hearing is being held regarding the proposal of the City to vacate the easements; and, WHEREAS, vacation of these easements is in the best interest of the City. NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AMES, IOWA, THAT: 1. Pursuant to Iowa Code Section 364.7, publication of notice regarding the proposed vacation of public utility easements and establishing a public hearing date regarding the proposal has been made. 2. The public hearing regarding the disposition of the property is hereby closed. 3.
