HomeMy WebLinkAboutA043 - Resolution No. 12-010 adopted January 10, 2012 RESOLUTION NO. 12-010 RESOLUTION APPROVING,SUBJECT TO CONDITIONS,AN AMENDED ADAPTIVE REUSE AND MAJOR SITE DEVELOPMENT PLAN FOR LOTS 1 AND 2 AND OUTLOT A OF THE STREETS OF NORTH GRAND MALL WHEREAS, the City has received an application for an Amended Adaptive Reuse and Major Site Development Plan for the Streets of North Grand Mall; and, WHEREAS,the proposed Adaptive Reuse Application and Major Site Development Plan comply with the applicable submission requirements of Sections 29.306 and 29.1502(4)(c) of the Ames Municipal Code; and, WHEREAS,the Planning and Zoning Commission,following public hearing,recommended approval of the proposed Adaptive Reuse Application and Major Site Development Plan with stipulations; and, WHEREAS,the City Council,after public hearing,finds that the Amended Adaptive Reuse Plan meets the purpose of the Adaptive Reuse provisions based on economic value to the City and further finds that the long-term benefits of the proposed adaptive reuse outweigh any negative impact on the neighborhood of the proposed project and on the City; NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Ames,Iowa, that the Amended Adaptive Reuse and Major Site Development Plan are approved subject to the conditions that follow: 1. That a remote parking agreement that satisfies the minimum parking requirements for Lots 1 and 2 be approved by the City Council; and 2. That a Supplemental Development Agreement for the Streets of North Grand be approved by the City Council; and 3. That authorization to implement Alternative A for Retail E as shown on sheet C3.1 of the Site Plan is subject to prior approval by City staff of a 45-foot access easement agreement; and 4. That the entire area of all landscaped traffic islands be excavated to a depth one foot below the bottom of the root ball of the proposed trees and that clean soil be installed. BE IT FURTHER RESOLVED that the City Council authorizes the Director of Planning and Housing to approve development of the areas shown on the Site Plan as Retail E and Restaurant F, but only upon satisfaction of the following conditions: 1. The minor site development plan for Retail E must be consistent with the approved adaptive reuse plan and must comply with the specific waivers granted therein; and 2. The minor site development plan for Retail E must include elevation drawings to indicate that the finish materials and architectural features are consistent on all four sides of the structure, and that window and door patterns or equivalent design features will also need to be carried around the building in a manner that ensures the design of the rear of the structure is appropriate for such prominent public exposure; and 3. The minor site development plan for Restaurant F must be consistent with the approved adaptive reuse plan and must comply with the specific waivers granted therein; and 4. The minor site development plan for Restaurants F and G must not allow for a deficit of parking to occur on Lots 1 and 2 combined; and 5. The minor site development plan for Restaurant F must contain a minimum of 960 square feet of landscape, or the equivalent to a three-foot border of landscaping around the proposed building,though landscaping can be placed any where within the .45 acre restaurant site. BE IT FURTHER RESOLVED that the City hereby grants permission to use areas within the public right-of-way and adjacent to the site to satisfy landscaping requirements as provided in Section 29.306(3)(b) of the Ames Municipal Code; and BE IT FURTHER RESOLVED that the City Council determines that the surface parking lot landscape plan meets the purposes described in Section 29.403(4)(a) of the Ames Municipal Code; and BE IT FURTHER RESOLVED that, prior to the issuance of any permits, the applicant must submit to and receive approval from the Public Works Department for construction plans compliant with all standards for public improvements; and BE IT FURTHER RESOLVED that, prior to clearing, grading, or issuance of building permits,the applicant must obtain a Construction Site Erosion and Sediment Control(COSESCO) permit.
