HomeMy WebLinkAboutA002 - Council Action Form dated June 12, 2007 a ITEM # 3�6 DATE 06/12/07 COUNCIL ACTION FORM SUBJECT: FINAL PLAT FOR DAYTON PARK SUBDIVISION, 5T" ADDITION BACKGROUND: The applicant is requesting that the Final Plat for Dayton Park Subdivision, 5th Addition be approved. The subject property consists of approximately 29.54 acres, and is generally located adjacent to the east and west sides of South Bell Avenue, north of Southeast 16 fh Street, between South Dayton Avenue and Interstate 35. Please refer to the attached Final Plat drawing and the Location Map. The proposed Final Plat involves the creation of four lots for industrial development, Lot'A' for public right-of-way (South Bell Avenue), and Outlot 'B' for storm sewer, surface water flowage and surface water storage easement purposes. The resolution approving the Preliminary Plat for Dayton Park Subdivision, 5th Addition, was approved by the City Council on May 23, 2006, (Resolution No. 06-201). Approval of the Preliminary Plat included a stipulation that requires rezoning of a portion of this subdivision from "A" (Agricultural)to"Gl" (General Industrial), at the time of approval of the Final Plat. The stipulation for approval reads as follows: "As a condition of approval of the Preliminary Plat, the portion of Lots 3 and 4, zoned as "A" (Agricultural), must be rezoned to "GI" (General Industrial). The developer must submit a request for rezoning to change the zoning designation of the west portion of Lots 3 and 4 from "A" (Agricultural)to "GI" (General Industrial). Such rezoning must be approved at the time of approval of the Final Plat for Dayton Park 5 Addition." Given this stipulation included in approval of the Preliminary Plat, the City Council cannot approve the Final Plat of Dayton Park, 5th Addition,without approving the rezoning request at the same City Council meeting. To approve the request for rezoning on June 12, 2007, would require that the City Council suspend the rules and waive the second and third readings of the ordinance to rezone. Without suspension of the rules, approval of the Final Plat must wait until the rezoning is approved at a future meeting of the City Council. To comply with Section 23.302(10)(e)of the Municipal Code,the City Council has sixty(60) days, following the Applicant's filing of the complete application for Final Plat approval, to approve, approve subject to conditions, or disapprove the application. The Final Plat application for Dayton Park Subdivision, 5th Addition was complete as of May 22, 2007. Therefore,the City Council is required to take action on the Final Plat no later than July20, 2007. ALTERNATIVES: 1. If the City Council chooses to suspend the rules for the second and third readings of the ordinance, on the separate agenda item to rezone a portion of this subdivision, the City Council can approve the Final Plat for Dayton Park Subdivision, 5th Addition. This alternative assumes that the City Council agree with the City staff opinion that the plat conforms to all subdivision standards. 2. If the City Council chooses not to suspend the rules for the second and third readings of the ordinance, on the separate agenda item to rezone a portion of this subdivision,the City Council can table action on the request until the third reading of the ordinance. 3. The City Council can refer these items back to staff and the developer for additional information. MANAGER'S RECOMMENDED ACTION: The staff finds that the proposed final plat conforms to all subdivisions requirements. Therefore, if the City Council chooses to suspend the rules for the second and third readings of the ordinance to rezone, the City Manager recommends that the City Council approve Alternative #1. This will approve the Final Plat for Dayton Park Subdivision, 5th Addition. However, if the City Council chooses not to suspend the rules for the proposed rezoning, the City Manager recommends Alternative #2.
