COUNCIL ACTION FORM
SUBJECT: PUBLIC UTILITY AND ACCESS EASEMENTS IN THE ESTATES OF
NATURE'S CROSSING
BACKGROUND:
Public Utility Easements were granted to the City of Ames with the Final Plat of The
Estates of Nature's Crossing Subdivision. These areas were general public utility
easements for use by utility companies such as phone, cable, and gas. In this case, the
request to vacate each easement has been confirmed with the respective utility
companies. The easement at The Estates of Nature's Crossing Subdivision is clear of
utilities.
The Public Access Easement on Lot 4 in The Estates of Nature's Crossing Subdivision
accommodates a sidewalk connection to Christopher Gartner Park. A portion of Lot 4 is
planned to be sold to the owner of the adjacent property. The remaining portion of Lot 4
as well as Lots 5, 6, and 7 are being consolidated. A revised location for the Public
Access Easement will be along the new property line as part of the Plat of Survey.
The existing easements on Lots 4, 5, 6, and 7 of The Estates of Nature's Crossing
Subdivision to be vacated are described as follows:
The Public Access Easement on the East 8 feet of Lot 4; and the Public Utility
Easements on the following: North 5 feet of Lot 5; and the North 5 feet and the
East 5 feet of Lot 6; and the South 5 feet of that portion of Lot 7 North of Lot 5
and Lot 6; and the West 5 feet of Lot 7 of that portion between Lot 6 and Lot 8.
ALTERNATIVES:
1. Approve the vacation of the Public Utility Easement as described above in The
Estates of Nature's Crossing Subdivision.
2. Retain the easements as granted.
MANAGER'S RECOMMENDED ACTION:
The registered right-of-way users have indicated no use for the existing easements.
Therefore, it is the recommendation of the City Manager that the City Council adopt
Alternative No. 1, thereby approving the vacation of the Public Utility Easement as
described above in The Estates of Nature's Crossing Subdivision.
