HomeMy WebLinkAboutA002 - Council Action Form dated April 10, 2007 ITEM # a7s aelb DATE 04/10/07 COUNCIL ACTION FORM SUBJECT: FINAL PLAT FOR THE ESTATES OF NATURE'S CROSSING SUBDIVISION AND VACATION OF A CONSERVATION EASEMENT BACKGROUND: The applicant is requesting that the Final Plat for The Estates of Nature's Crossing Subdivision be approved. The subject property consists of approximately 15.15 acres,and is generally located east of South Dakota Avenue and south of Harris Street, Christopher Gartner Park, and the Mary Greeley Medical Center Israel Family Hospice House. Please refer to the attached Final Plat drawing and the Location Map. The proposed Final Plat involves the creation of 24 lots for single-family detached homes and Lot 'A' for public right-of-way, Cochrane Parkway. The area being platted for development is zoned as "RL" (Residential Low Density). The following documents have been submitted and are associated with this Final Plat application: • A Mortgagee's Consent to Platting and Partial Release; • A Resolution to accept public improvements and a bond for those improvements; • An Agreement for Public. Improvements; • An Easements document; • A Resolution Accepting the Plat of The Estates of Nature's Crossing Subdivision; • A Certificate of the Treasurer of Story County, Iowa, certifying that the subject property is free from certified taxes and certified special assessments; • An Attorney's Opinion, which states that the subject property is free from encumbrances excepting easements and restrictions of record; and, • Consent and Dedication of Lot 'A' to the City of Ames for right-of-way purposes. An existing conservation easement, which precludes development of any kind, currently exists on the subject property. To allow the construction of a shared use pathway within the easement area,the existing conservation easement will need to be vacated. The Legal Department has created a new conservation easement, which allows the construction of the shared use pathway, yet continues to protect this corridor. ALTERNATIVES: 1. The City Council can approve the Final Plat for The Estates of Nature's Crossing Subdivision and the vacation of the existing conservation easement. 2. The City Council can deny approval of the Final Plat for The Estates of Nature's Crossing Subdivision and the vacation of the existing conservation easement. 3. The City Council can refer these items back to staff and the developer for additional information. MANAGER'S RECOMMENDED ACTION: It is the recommendation of the City Manager that the City Council approve Alternative #1. This will approve the Final Plat for The Estates of Nature's Crossing Subdivision and vacate the existing conservation easement.
