COUNCIL ACTION FORM
SUBJECT: SANITARY SEWER EASEMENT IN THE ESTATES OF NATURE'S
CROSSING SUBDIVISION
BACKGROUND:
A 10-foot Sanitary Sewer Easement was granted to the City of Ames with the Final Plat
of Willow Creeks Estates 4th Addition. This easement was provided on Lot 2 for an 18-
inch sanitary sewer. This lot is currently being developed as part of The Estates of
Nature's Crossing Subdivision. The sanitary sewer alignment did not leave adequate
area for single-family home construction on proposed Lots 14,� 15, and 16 of the
Estate's of Nature's Crossing Subdivision. The sanitary sewer was realigned, removing
a portion of the existing infrastructure through those lots. A new sanitary sewer
easement over the realigned sanitary sewer will be provided with the Final Plat of The
Estate's of Nature's Crossing Subdivision.
The existing 10-foot Sanitary Sewer Easement on Lots 14, 15, and 16 of The Estates of
Nature's Crossing Subdivision to be vacated is described as follows:
Commencing at the Southeast corner of Lot 2, Willow Creek Estates, Fourth Addition, in
the City of Ames, Iowa; Thence N 00010'52"W, 35.91 feet along the East line of said Lot
2, Thence N 89018"32" W, 30.00 feet; Thence N 00010'52"W, 62.30 feet to the Point of
Beginning; (The next 6 calls are along the existing 10 foot sanitary sewer easement,
recorded in book 251, page 341, that is to be vacated)Thence N 68047'20"W, 125.34
feet; Thence S 70056'20"W, 144.33 feet; Thence N 00008'16"W, 10.57 feet along the
West line of Lot 16 of the proposed "The Estates of Nature's Crossing Subdivision";
Thence N 70056'20" E, 144.57 feet; Thence S 68047'20" E, 125.09 feet ; Thence S
00010'52" E, 10.74 feet to the Point of Beginning.
ALTERNATIVES:
1. Approve the vacation of the 10-foot Sanitary Sewer Easement on Lots 14, 15, 16
of The Estates of Nature's Crossing Subdivision.
2. Retain easement as granted.
MANAGER'S RECOMMENDED ACTION:
The sanitary sewer on Lots 14, 15, and 16 has been relocated, changing the original
alignment. Therefore, it is the recommendation of the City Manager that the City
Council adopt Alternative No. 1, thereby approving the vacation of the 10-foot Sanitary
Sewer Easement on Lots 14, 15, 16 of The Estates of Nature's Crossing Subdivision.
