ACCESS EASEMENT
This Access Easement is established by Alan J. Nacin and Susan M. Nacin, who
are the owners of the following described property:
A Subdivision of Lot 1 in Arnold Acres Subdivision of that
part of the Southeast Quarter of the Southeast Quarter of
Section 23, Township 84 North, Range 24 West of the 5th
P.M., Story County, Iowa, lying South of the Public Highway,
containing 5.11 acres.
Said property contains Lots 1, 2, 3 and 4. The following easement is hereby
established which shall be perpetual and a covenant running with the land to provide
access over, across, and through Lot 2 to and from Lot 3 described as follows:
A part of Lot 2 of Nacin Subdivision in the Southeast Quarter
of the Southeast Quarter of Section 23, Township 84 North,
Range 24 West of the 5th P.M., Story County, Iowa being
more particularly described as follows: Beginning at the
Northeast Corner of said Lot 2; thence S 16'54'45"E, 47.78
Feet along the East line of said Lot 2; thence N73°45'15"W,
152.60 Feet to a point on the West line of said Lot 2; thence
N00°43'43"W, 41.82 Feet along said line; thence
S73°45'15"E, 138.67 Feet to the Point of Beginning,
containing 0.13 Acres.
The owner of Lot 3 shall have the right of ingress and egress over, across, and
through the above-described easement. The owner of Lot 3 shall be responsible for the
maintenance, repair, and reconstruction of the driveway in said easement. The owner of
Lot 2 is entitled to use whatever portion of the driveway existing in said easement, and
the owner of Lot 3 will in no way interfere with the use of said driveway in the easement
by the owner of Lot 2 and its invitees, delivery people, and visitors.
