COUNCIL ACTION FORM
SUBJECT: FINAL PLAT FOR NACIN SUBDIVISION
BACKGROUND:
The property owners are requesting that the Final Plat for Nacin Subdivision be approved.
The subject property consists of approximately 5.11 acres, and is located directly east of
547th Avenue and directly south of East Riverside Road,within Story County and within the
Urban Fringe Boundary. Please refer to the attached Final Plat drawing and the Location
Map.
The proposed Final Plat involves the creation of four lots for single-family residential
detached development.
The Story County zoning designation for the subject property is "R-1" (Residential District
1). The R-1 zoning district allows mainly single-family detached dwellings and other low
density uses.
The City Council approved the Preliminary Plat for Nacin Subdivision on November 14,
2006, via Resolution No. 06-466 with the following stipulations:
1. Prior to Final Plat approval by the City of Ames, the property owners shall create a
conservation easement, or other agreement as approved by Story County,to prohibit
construction activities within the designated Natural Area, as identified on Lot 4 of the
Preliminary plat; and,
2. According to Municipal Code Section 23.302(7)(b), the Final Plat must be submitted
to the Planning and Housing Department for approval within one year from the date of
City Council approval of the Preliminary Plat.
The property owners have complied with both of the stipulations listed above.
The Legal Department staff prepared a "Covenant for Assessment of Costs of
Improvements"and a"Covenant Pertaining to Water Service", which have been signed by
the property owners of the Nacin Subdivision. The covenants are described as follows:
• The Covenant for Assessment of Costs of Improvements identifies that the
property owners waive their rights to object to future assessments for public
improvements including, but not limited to, street paving, bicycle paths,
sidewalks, and utility improvements.
• The Covenant Pertaining to Water Service identifies that the property owners
agree to pay any and all costs related to disconnection of the rural water
facilities at the time land in this subdivision is annexed into the City of Ames.
The following documents have been submitted and are associated with this Final Plat
application:
• A Covenant pertaining to the Natural Area located on Lot 4;
• A Treasurer's Certificate from the Treasurer of Story County, Iowa, certifying that
the subject property is free from taxes;
• Access Easement;
• Owner's Consent;
• An Attorney's Opinion which states that the subject property is free from
encumbrances excepting easements and restrictions of record; and,
• A Mortgagee Consent.
ALTERNATIVES:
1. The City Council can approve the Final Plat for Nacin Subdivision.
2. The City Council can deny the Final Plat for Nacin Subdivision.
3. The City Council can refer these items back to staff and the developer for additional
information.
MANAGER'S RECOMMENDED ACTION:
It is the recommendation of the City Manager that the City Council approve
Alternative #1. This will approve the Final Plat for Nacin Subdivision. All subdivision
requirements have been fulfilled.
