RESOLUTION NO. 06-465
RESOLUTION TO ABANDON SIX EASEMENTS IN WAL-
MART'S SUBDIVISION, FIRST ADDITION,AMES, STORY
COUNTY,IOWA
BE IT RESOLVED,by the City Council of the City of Ames, Iowa, that the following easements in
the First Addition of Walmart's Subdivision, Ames, Story County, Iowa are abandoned:
1) A ten-foot wide electrical easement shown on the Plat of Survey of Parcel"AA"recorded as
Instrument No.03-09980 on May 20,2003 on Slide 166,Page 4 of the Story County Recorder's
office,situated five feet on either side of the following centerline:
Commencing at the northwest corner of said Parcel"AA",thence S 89°21155"E 2.44 feet to the point
of beginning,thence S 06°26'58"E 83.07 feet to a point,thence S 2725106"E 76.04 feet to a point.
2) A ten(10)-foot wide electric easement centered five(5)feet on each side of the following:
From the center of Section 11-T83N-R24W of the 5a'P.M. in the City of Ames, Story County,Iowa;
south 99.4 feet,thence 415 feet south 89 degrees 11 minutes East,thence South 92.6 feet,thence 347
feet south 89 degrees 11 minutes East,thence North 5'to the point of beginning. Thence 348 feet
South 89 degrees 11 minutes East,thence North 819.7 feet,thence 405.27 feet North 89 degrees 11
minutes West to the East right-of-way line end South East Fifth St.
3) A water main easement shown on:
"Plat of Survey Parcel"AA"recorded as Instrument No. 03-09980 on May 20,2003 on Slide 166,
Page 4 of the Story County Recorder of Deeds Office.
4) A right-of-way permit and easement described as:
A strip of land 10 feet wide,being 5 feet on each side of the following described centerline:
Commencing at the Northwest corner of the South 20 acres on the South Half of the Northeast Quarter
of Section 11,Township 83 North,Range 24 West of the 5`h P.M.,Story County,Iowa;thence South
185 feet;thence South 89011'East 60 feet to the point of beginning;thence South 89°11'East 787.0
feet.
Also a strip of land 10 feet wide,being 5 feet on each side of the following described centerline:
Commencing at the Northwest corner of the South 20 acres on the South Half of the Northeast Quarter
of Section 11,Township 83 North,Range 24 West of the 5`b P.M., Story County,Iowa;thence South
185 feet;thence South 89°11'East 769.5 feet to the point of beginning;thence South 30 feet.
5) A storm sewer easement shown as:
Being part of Parcel"AF"as recorded on Slide 269,Pages 5 and 6 on January 27,2006,also being
part of Lot 1 "Final Plat"Wal-Mart's Subdivision,First Addition all in the Story County Recorder of
Deeds Office,all being part of the Southwest Quarter of the Northeast Quarter of Section 11,
Township 83 North,Range 24 West of the 5th P.M.,City of Ames,Story County,Iowa to wit:
Commencing at a found cross in manhole lid at the East Quarter of said Section 11,thence along the
south line of said northeast quarter N89°-12'-04"W 1503.05 ft.to a point on the east line of an
existing Storm Sewer Easement recorded as Document No. 97-01721;thence leaving said south
quarter section line along said east line N00°-29'-54"w 331.23 ft.to the point at the northeast corner
of said Storm Sewer Easement No.97-01721 also being the southeast corner of Storm Sewer
Easement No. 97-00941 at the point of beginning;thence leaving said north line along the south line
of said 97-00941,also being the north line of said 97-01721 N89°-10'-51"W 20.01 ft.to the
southwest corner of said 97-00941,also being the northwest corner of said 97-01721;thence leaving
said line along the west line of said 97-00941 N00°-37'-42"W 336.55 ft.to a point on the south line of
said 97-00941;thence leaving said west line along said south line N89°-59'-49"W 215.09 ft.to the
intersection of said south line and the south right-of-way line of Southeast 5th Street;thence leaving
said south easement line along said south right-of-way line along a curve deflecting to the left having a
radius of 380.00 ft.,an arc length of 32.15 ft.,a chord bearing of N61°-02'-58"E,a chord distance of
32.14 ft.to a found iron rod,thence along a curve deflecting to the right having a radius of 300.00 ft.,
an arc length of 55.71 ft.,a chord bearing of N63°-56'-45"E,a chord distance of 55.63 ft.to a point at
the intersection of said south right-of-way line and the north line of said easement;thence leaving said
south right-of-way line along said north easement line S89°-59'-45"E 108.29 ft.to a point;thence
leaving said north easement line along the east line of said easement S00°-37'41"E 376.75 ft.to the
point of beginning.
6) A storm sewer easement shown on Plat#97-01721 being part of Parcel"AE"as recorded on Slide
270,Pages 1 and 2 and being part of Lot 1 "Final Plat"Wal-Mart's Subdivision,First Addition all in
the Story County Recorder of Deeds Office,all being part of the Northwest Quarter of the Southeast
Quarter Section 11,Township 83 North,Range 24 West of the 5th P.M.,City of Ames, Story County,
Iowa to wit:
Commencing at a found cross in manhole lid at the East Quarter of said Section 11,thence along the
south line of said northeast quarter N89°-12'-04"W 1503.05 ft. to a point on the east line of said
Storm Sewer Easement;thence leaving said south quarter section line along said east line S00°-29'-
54"E 365.40 ft.to the intersection of said east line and the south line of said Lot 1;thence leaving said
east line along said south line N89"-33'-07"W 20.00 ft.to a point at the intersection of said south line
and the west line of said easement;thence leaving said south lot line along said west easement line
N00°-29'-54"W 696.76 ft.to a found iron rod at the northwest corner of said easement;thence leaving
said west line along the north line of said easement S89°-10'-51"E 20.01 ft.to the northeast corner of
said easement;thence leaving said north line along said east line S00°-29'-54"E 331.23 ft.to the point
of beginning.
All other parts of said easements are retained by the City of Ames and shall remain in full force and
effect.
