GOODWIN TELEPHONE 515-232-7390 FAX 515-232-7396 April 20, 2006 Ms. Ann Campbell, Mayor and 0 L E Ames City Council Members c/o Ames City Hall APR 21 515 Clark Avenue Ames, IA 50010 CITY CLERK CITY Of AMES,IOWA Re: Wal-Mart Project Dear Mayor Campbell and City Council Members: I am attorney for Pro-Group, L.L.C., which through its members, Jerry Nagle, Tom Burke and Brad Fullmer, entered into a Lease Agreement on April 5, 2003, with Ward Development, L.C. to lease the building at 522 South Duff Avenue, Ames, Iowa. The term of the lease is five (5) years which continues until March 31, 2008, with a five (5) year option to renew the lease. My clients are still paying $21,000.00 per month rent for the premises. My clients have been unable to agree to a buy out of their lease with Ward Development, L.C. My clients want the City of Ames to be aware of their continued leasehold interest in the property which needs to be satisfied before approval of the Final Plat for this project.
