HomeMy WebLinkAboutA002 - Council Action Form dated October 24, 2006 ITEM # !� DATE 10/24/06 COUNCIL ACTION FORM SUBJECT: FINAL PLAT FOR HY-VEE SUBDIVISION, FIRST ADDITION, AND APPROVAL OF THE DEVELOPMENT AGREEMENT BACKGROUND: The applicant is requesting approval of the Final Plat for Hy-Vee Subdivision, First Addition. The Final Plat includes approximately 1.92 acres and is generally located south of Lincoln Way, between Dotson Drive and Beedle Drive. In addition, approval of a Development Agreement is requested,which requires that the Developer shall at such time the City widens or otherwise modifies Lincoln Way in the area abutting the site, construct improvements to the specifications of the City as follows: A. A retaining wall at such location and to such specifications determined by the City; and, B. A fence separating the site from Lincoln Way at such location and to such specifications determined by the City. The Final Plat establishes Lot 1 for commercial development and Lots A and B for street right-of-way. Lot"A" increases the width of right-of-way for Beedle Drive by 20 feet along a portion of the west boundary of the subdivision. Lot"B" increases the width of right-of-way for Dotson Drive by 20 feet along the entire east boundary of the subdivision. A portion of the former right-of-way for Lincoln Swing has been previously vacated by the City Council and is now included as part of the proposed subdivision. Land in the proposed subdivision is zoned as "HOC" (Highway-Oriented Commercial). ALTERNATIVES: 1. The City Council can approve the Final Plat and Development Agreement for Hy-Vee Subdivision, First Addition. 2. The City Council can deny approval of the Final Plat and Development Agreement for Hy-Vee Subdivision, First Addition. 3. The City Council can refer this item back to staff and/or the developer for additional information. MANAGER'S RECOMMENDED ACTION: All subdivision requirements for this approval have been fulfilled. Therefore, it is the recommendation of the City Manager that the City Council approve Alternative# 1.
