Hastings, hereby state that I am an Attorney at Law, duly admitted to the practice of law in the State of Iowa, and a member of the firm of Hastings & Gartin, LLP, with offices at 409 Duff, Ames, Iowa 50010. 1 further state that I have examined the Abstract of Title to the following described real estate, located in Story County, Iowa: Lots 8, 9, 10, and 11, South Gateway Development, Ames, Iowa from the date of the root of title thereof, down to and including May 16, 2006, at 2:42 P.M., which abstract was last certified by Abstract & Title Services of Story County. The real estate has been subdivided and is now to be known as South Gateway Development, Plat 2, Ames, Iowa. Based upon information within the Abstract of Title, it is my opinion that the fee simple title to said real estate is in RADHE, INC. as to Lot 1 of South Gateway Development, Plat 2, Ames, Iowa and SOUTH DAYTON DEVELOPMENT, L.C. as to Lots 2, 3, and 4 of South Gateway Development, Plat 2, Ames, Iowa, and that said real estate is free from all encumbrances excepting, however, the following: a. Mortgage to Commercial Federal Bank FSB dated November 6, 2001, and recorded on November 13, 2001 as Inst. No. 01=-1.5610—of'the records of the Story County Recorder. b. Mortgage to Ames Community Bank dated January 17, 2003, and recorded on August 22, 2003 as Inst. No.,03=177467 of the records of the Story County Recorder.
