SUBJECT: FINAL PLAT FOR SOMERSET SUBDIVISION, TWENTY FIRST
ADDITION
BACKGROUND:
The applicants are requesting that the Final Plat for Somerset Subdivision, Twenty First
Addition be approved. The subject site is an official replat of Outlot Y in Somerset
Subdivision, First Addition and Outlots Y and Z in Somerset Subdivision, Twentieth
Addition. The subject property consists of approximately 24 acres and is generally located
east of George Washington Carver Avenue, west of Stange Road, north of Northridge
Parkway, and south of Bloomington Road. The purpose of this plat is to allow for the
development of 42 single family residential lots.
The proposed subdivision creates 42 new numbered lots (Lots 1 —42), four new lettered
lots (Lots A, B, C and D), and four outlots (Outlot W, XX, YY and ZZ). Lots 1-42 will be
developed for residential uses.
The proposed subdivision is zoned "F-VR" (Village Residential District) and meets the
minimum zoning,:standards for lot size, frontage, and density. The Final Plat is consistent
with the approved Preliminary Plat for the proposed subdivision.
The developer, E&M Hunziker Development, have filed an Irrevocable Letter of Credit with
the City Clerk's office in the amount of $323,000. This amount will be used for the
development of paving and street lights.
One significant issue was discovered during review of this Final Plat. The Major Site Plan
for Somerset that was approved previously identifies Lots 30, 31, and 32 (as shown on the
proposed Final Plat) as the southern portion of an approved church, site, which was
intended to be approximately 1.04 acres in size. Lots 30, 31, and 32 are now being
proposed through the Somerset Final Plat, Twenty-First Addition as single family
residential, Country Houses. The property owner has promised the subject properties to
Mainstream Living,whose mission is to provide services to persons with disabilities,which
are designed to:enhance opportunities, create success, and fulfill dreams. Altering the
approved Major Site Plan for Somerset requires the property owner to apply for a Major
Site Plan Revision, which will be reviewed by the staff Development Review Committee
and the Planning and Zoning Commission. The decision to accept the Major Site Plan
revision is ultimately made by the members of the City Council.
Subdivision Ordinance Section 23.302 (10) (d) provides a standard, which allows the City
Council to place a condition of approval on the subject Final Plat:
Prior to granting approval of a major subdivision Final Plat, the City Council
may permit the plat to be divided into two or more sections and may impose
such conditions upon approval of each section as it deems necessary to
assure the orderly development of the subdivision.
As a result of this review, it has been determined that the Final Plat for Somerset
Subdivision, Twenty First Addition should be approved subject to the following stipulation:
1. Prior to the issuance of a building permit on Lots 30, 31, and/or 32, as shown on the
Somerset., Final Plat, Twenty First Addition, the property owner shall receive
approval for a Major Site Plan Revision, which eliminates the church site and
replaces it with residential lots. If the property owner is unable to receive approval
of the Major Site Plan Revision,then Lots 30, 31, and 32 will need to be replatted as
part of Outlot W.
ALTERNATIVES:
1. The City Council can approve the Final Plat for Somerset Subdivision,Twenty First
Addition with the stipulation outlined above.
2. The City Council can approve the Final Plat for Somerset Subdivision, Twenty First
Addition without the stipulation outlined above.
3. The City Council can deny approval of the Final Plat for Somerset Subdivision,
Twenty First Addition.
4. The City Council can refer the Final Plat back to staff and the property owners for
additional information.
MANAGER'S RECOMMENDED ACTION:
By working together, staff and the developer have identified a way for this Final Plat to be
approved while-fulfilling the Code's requirement for a Master Plan change for the site
formerly reserved for a church. This will allow construction to begin on the remaining 39
lots while the developer submits his Master Site Plan for approval.
Therefore, it is the recommendation of the City Manager that the City Council approve
Alternative #1. This will approve the Final Plat for Somerset Subdivision, Twenty First
Addition, subject to the stipulation outlined above. All other subdivision requirements have
been fulfilled.
