COUNCIL ACTION FORM
SUBJECT: WAIVER OF PUBLIC IMPROVEMENT REQUIREMENTS FOR
NORTHWOOD HEIGHTS THIRD SUBDIVISION
BACKGROUND:
Northwood Heights Third Subdivision is located in Story County generally east of North
Dakota Avenue and south of Cameron School Road. This subdivision involves replatting
Lot 19 of Northwood Heights Second Subdivision into two single-family lots and one
Outlot that will be used for storm water management and environmental features.
Although this subdivision is in Story County, it is within the two mile jurisdictional limits
of the City of Ames, and thus subject to municipal subdivision requirements. These
include the requirement for new subdivisions to provide public infrastructure
improvements in compliance with City standards. The developer, Hunziker and
Associates, has submitted a letter requesting that City Council waive the public
improvement requirements for this subdivision.
The platting of these two single-family lots and the Outlot will complete Northwood
Heights Subdivision. This addition will have a very low impact on the area and does not
create a need for urban utilities. The subdivision is not adjacent to the corporate limits
and is not an area that is needed to facilitate utility extensions into developing land. The
Outlot will be utilized as a storm water management facility that will be planted in native
grasses. The Developer has stated that further subdivision of these lots will not occur.
Also, a letter of support has been received from members of the existing homeowners
association. The existing internal street system is a private drive within an easement
that will be maintained by the association.
In the Draft Urban Fringe Plan, the subject property is designated as Rural Transitional
Residential, within the group of uses called "Rural/Urban Transition Area." Generally,
these areas are expected to have rural character, but may find urban areas adjacent
someday or otherwise be part of the transition from urban to rural that develops around
edges of a growing community. The description of this Rural Transitional Residential
land use type includes single and two-family residences at densities of two units per
acre or lower. Generally, this type of use would not be required to have urban type
infrastructure, except in certain key locations where this is necessary for the orderly and
efficient growth of the urban community. The draft plan also says that it is important in
these areas to .mitigate environmental impacts that development of rural residential
areas might have on storm water runoff, soil erosion, and waste water discharge. The
Urban Fringe Plan is only a draft document, and has not been adopted as a policy by
the City Council.
ALTERNATIVES:
1. The City Council can waive the public improvement requirements for Northwood
Heights Third Subdivision, as requested by Hunziker and Associates.
2. The City Council can require the installation of public improvements.
MANAGER'S RECOMMENDED ACTION:
This addition of two single-family lots will complete the development of the Northwood
Heights Subdivision. This area is not incorporated into the city and is not adjacent to nor
near the corporate limits. The area is far enough removed that annexation would not be
expected for many years. Due to this fact, any utilities installed in this subdivision would
not be allowed to connect into the City systems. The existing private drive network
would be used to access the new lots. No new streets or street connections would be
required. The homeowners' association would maintain the existing streets.
Also, Hunziker and Associates have been proactive with involving the existing residents
and accommodating their concerns, as evidenced by the letter of support from the
homeowners' association.
Therefore, it is the recommendation of the City Manager that the City Council
adopt Alternative #1, thereby waiving the public improvement requirements for
Northwood Heights Third Subdivision, as requested by Hunziker and Associates.

Hunziker Land Development is in the process of developing the Northwood Heights
Subdivision. Attached is a copy of the preliminary plat as well as a letter of support from
the surrounding home owners association.
Hunziker Land Development is requesting the city council to waive the requirements for
all public improvements for this particular subdivision.
We have already had the preliminary plat approved by the story county planning and
zoning commission and the story county board of supervisors.
Our.next step is to have the City of Ames approve the plat before it can go back to the
county for approval of the final plat.

Based on conversations with Chuck Winkleblack,representative of Hunziker and
Associates, it is our understanding that:
• The application proposes to create two residential building lots and an OUTLOT
Won the property of LOT 19 of NORTHWOOD HEIGHTS SECOND
SUBDIVISION (PIN # 05-20-300-370).
• A conservation easement(OUTLOT `A') will consist of approximately 2.6 acres,
be located at the east end of the parcel and deeded to the Lot Owners'
Association.
• The developer will seed this OUTLOT and an easement area of approximately
100' x 100' over the NE corner of the Third Subdivision's Lot 1 to help slow
water flow. This will be done with native grasses and take 2 or 3 years to
establish.
• Additional easements proposed will preserve current pavement locations and
drainage routes.
The buyers of Lots I and 2 of Northwood Heights Third Subdivision will become
members of our Lot Owners' Association,the Association's by-laws and
restrictive covenants will apply, and no further subdivision of the two lots shall
occur.
The above easements and reduction in the number of lots proposed seems to be a
satisfactory compromise and is supported by the Northwood Heights II Lot Owners'
Association.
