HomeMy WebLinkAboutA008 - Council Action Form dated March 8, 2005 ITEM # Z DATE 03/08/05 COUNCIL ACTION FORM SUBJECT: FINAL PLAT FOR AIRPORT ROAD SUBDIVISION, THIRD ADDITION BACKGROUND: The property owners, Airport Road Developers, L.C., are requesting approval of the Final Plat for Airport Road Subdivision, Third Addition (See attached Final Plat). The proposed subdivision extends the entire distance between Airport Road and Kitty Hawk Drive. Proposed "Lot 1" has frontage at 309 Kitty Hawk Drive, and proposed "Lot 2" has frontage at 300 Airport Road. The developer proposes to change the lot configuration of two previously platted lots. Proposed "Lot 1" is an expansion of an existing "Lot 1" from the Second Addition of Airport Road Subdivision. Proposed "Lot 2" is a replat of existing "Lot 8" from the original Airport Road Subdivision. A total of approximately 1.31 acres of land from existing "Lot 8" will be combined with existing "Lot 1" to form proposed "Lot 1." Both proposed lots are intended for commercial development. A total of 17.13 acres of land are included in the proposed subdivision. The property is currently zoned "HOC" (Highway-Oriented Commercial). The proposed lots meet the requirements of the Zoning Ordinance. There are no public improvements to be installed with this Final Plat, with the exception of the installation of public sidewalk along the south property line of Lot 1, in the right-of-way for Kitty Hawk Drive, and along the north property line of Lot 2, in the right-of-way for Airport Road. The applicant has submitted an "Agreement for Sidewalk" to ensure the installation of these improvements. As a result of this review, staff has determined that the Final Plat for Airport Road Subdivision, Third Addition should be approved, with the following stipulations: 1. That the developer provides written verification from the Iowa Department of Natural Resources (IDNR), regarding the relocation of the existing monitoring well on the site to City staff, prior to the issuance of any building permits for the site; 2. That the developer properly abandons the existing monitoring well subject to the requirements of the IDNR, prior to any land disturbance on the site; and, 3. That the developer provides a copy of the NPDES permit to the City staff, prior to any land disturbance on the site. ALTERNATIVES: 1. The City Council can approve the Final Plat for Airport Road Subdivision, Third Addition, with the stipulations listed above. 2. The City Council can deny approval of the Final Plat for Airport Road Subdivision, Third Addition. 3. The City Council can refer the Final Plat for Airport Road Subdivision,Third Addition back to staff and/or the property owners for additional information. CITY MANAGER'S RECOMMENDED ACTION: Because the proposed Final Plat meets all requirements, it is the recommendation of the City Manager that the City Council approve Alternative#1. This will approve the Final Plat for Airport Road Subdivision Third Addition, with the following stipulations: 1.
